SYNOPSIS
Eliminates tenure rights accrued by certain superintendents of schools in other administrative positions previously held in the district.

An Act concerning superintendents of schools and amending and supplementing P.L.1991, c.267 (C.18A:17-20.1 et seq.).
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. Section 8 of P.L.1991, c.267 (C.18A:17-20.4) is amended to read as follows:
8. Nothing in this section or in this act shall affect any tenure rights which shall have already accrued to any superintendent prior to the effective date of this amendatory and supplementary act. [A] Except as otherwise provided in section 2 of P.L. , c. (C. ) (pending before the Legislature as this bill), a superintendent of schools promoted from within a district shall retain all tenure rights accrued in any position which was previously held by the superintendent in the district.

2. (New section) Notwithstanding the provisions of section 8 of P.L.1991, c.267 (C.18A:17-20.4) or any other law to the contrary, a superintendent of schools whose initial employment contract in that position in a school district takes effect after the effective date of P.L. , c. (C. ) (pending before the Legislature as this bill), shall not retain tenure rights accrued in any position requiring an administrative certification with either a school administrator endorsement or a principal endorsement, which was previously held by the superintendent in the district.
3. This act shall take effect immediately.
STATEMENT
This bill would eliminate, for a superintendent of schools who is promoted to that position from within the district, any tenure rights he has accrued in any other position in the district which requires an administrative certification with either a school administrator endorsement or a principal endorsement. The bill would only apply to superintendents whose initial employment contract with the district in that position is effective after the effective date of this bill.
