SYNOPSIS
Validates certain fire district obligations.

An Act to validate certain proceedings of fire districts and any bonds or other obligations issued or to be issued pursuant to such proceedings.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. Proceedings had or taken by any board of fire commissioners or at any fire district meeting or election for the authorization or issuance of bonds or other obligations of the fire district issued or to be issued pursuant to a resolution of the board of commissioners of such fire district approved by the legal voters at such fire district election are herby ratified, validated, and confirmed, notwithstanding that notices to persons desiring absentee ballots were not prepared and published as required by section 6 of the "Vote by Mail Law," P.L.2009, c.79 (C.19:63-6), and notwithstanding that the ballot question that was submitted to the voters did not refer specifically to the issuance of "bonds" as may be required by N.J.S.40A:14-86; provided, however, that the voters authorized a debt obligation not to exceed $1,346,314.00, and that no action, suit, or other proceeding of any nature to contest the validity of the proceedings has been instituted prior to the effective date of this act and within the time fixed therefor by or pursuant to law or rule of court, or when such time has not expired, if instituted within 30 days after the effective date of this act.
2. This act shall take effect immediately.
STATEMENT
This bill would validate the proceedings of the Buena Vista Fire District No.2, Atlantic County, bond issue on December 5, 2009. A fire district bond issuance question was overwhelmingly approved by the electorate, notwithstanding that certain notices concerning absentee ballots were not published and that the ballot question that was submitted to the voters did not refer specifically to the issuance of "bonds."
This validating act would permit the Buena Vista Fire District to proceed with the erection of a new fire house facility to better serve and protect the citizens of Buena Vista Township.
