SYNOPSIS

     School bond validating act.

An Act to validate certain proceedings of school districts and any bonds or other obligations issued or to be issued pursuant to those proceedings.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    All proceedings heretofore had or taken by any school district or at any school election for the authorization or issuance of bonds of the school district and any bonds or other obligations of the school district issued or to be issued in pursuance of any proposal adopted by the legal voters at such election, are hereby ratified, validated and confirmed, notwithstanding that the proposal did not conform with the requirements of N.J.S.18A:22-39; provided that no action, suit, or other proceeding of any nature to contest the validity of the proceedings has heretofore been instituted prior to the date on which this act takes effect and within the time fixed therefor by or pursuant to law or rule of court, or when such time has not heretofore expired, if instituted within 15 days after the effective date of this act.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill would validate the school bond authorization proceedings taken by the Board of Education of the Monmouth Regional High School District, Monmouth County, and approved by the voters at the school election held November 6, 2012.
