SYNOPSIS

     Prohibits developer from diverting storm water runoff to adjacent or nearby private property.

An Act concerning storm water management and supplementing P.L.1975, c.291 (C.40:55D-1 et seq.).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  No developer may construct a development in a manner that will cause or facilitate the runoff of storm water from the development onto adjacent or nearby private property owned by another person.

     b.    No municipal agency or State entity shall approve a storm water management plan for a development that includes a provision that plans for or allows, in an emergency or otherwise, storm water runoff from the development to be diverted onto adjacent or nearby private property owned by another person.

     1c.   Notwithstanding the provisions of subsections a. and b. of this section to the contrary, the runoff of storm water from development onto adjacent or nearby private property owned by another person may be allowed, provided that the runoff of storm water from the development onto adjacent or nearby property occurs:

     (1)   at a volume and rate equal to, or less than, the volume or rate of runoff prior to the development;

     (2)   in a stable manner that does not cause or exacerbate soil erosion; and

     (3)   at a location currently serving as a receiving point of discharge.1

 

     2.    This act shall take effect on the 90th day after the date of enactment.
