SYNOPSIS

     Requires information concerning certain public employees be made public.

An Act concerning certain public employees and supplementing Title 52 of the Revised Statutes and Titles 18A and 40A of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.  Notwithstanding any law, rule, or regulation to the contrary, the State, including any authority, board, body, commission, agency or other instrumentality of the State, shall provide and make available to the public the following information concerning any person employed in a full or part-time position with the State or any

authority, board, body, commission, agency, or other instrumentality of the State who has regular and direct contact with the general public as a service provider or in providing a service:

     (1) The record with respect to all customer complaints made concerning that employee, including any safety violation;

     (2) A description of any disciplinary action taken by the State, authority, board, body, commission, agency, or other instrumentality of the State against that employee, including, but not limited to, discharge or suspension; and

     (3) Any other information relating to the performance of that employee that the State, authority, board, body, commission, agency, or other instrumentality of the State routinely compiles.  

 

     2.  Notwithstanding any law, rule, or regulation to the contrary, a county, municipality, or other political subdivision of the State, or an authority, board, body, agency, district, commission, or instrumentality of the county, municipality, or subdivision shall  provide and make available to the public the following information concerning any person employed in a full or part-time position with the county, municipality, or other political subdivision of the State, or an authority, board, body, agency, district, commission, or instrumentality of the county, municipality, or subdivision who has regular and direct contact with the general public as a service provider or in providing a service:

     (1) The record with respect to all customer complaints made concerning that employee, including any safety violation;

     (2) A description of any disciplinary action taken by the county, municipality, or other political subdivision of the State, or  an authority, board, body, agency, district, commission, or instrumentality of the county, municipality, or subdivision against that employee, including, but not limited to, discharge or suspension; and

     (3) Any other information relating to the performance of that employee that the county, municipality, or other political
subdivision of the State, or an authority, board, body, agency, district, commission, or instrumentality of the county, municipality, or subdivision routinely compiles.  

 

     3.  Notwithstanding any law, rule, or regulation to the contrary, every board of education, or an agency or instrumentality thereof, shall provide and make available to the public the following information concerning any person employed in a full or part-time position with the board of education, or agency or instrumentality thereof, who has regular and direct contact with the general public as a service provider or in providing a service:

     (1)   The record with respect to all customer complaints made concerning that employee, including any safety violation;

     (2)   A description of any disciplinary action taken by the board of education, or agency or instrumentality thereof, against that employee, including, but not limited to, discharge or suspension; and

     (3) Any other information relating to the performance of that employee that the board of education, or agency or instrumentality thereof, routinely compiles.  

 

     4.    This act shall take effect on the first day of the third month following enactment. 

 

 

STATEMENT

 

     This bill requires that the State, including any authority, board, body, commission, agency or other instrumentality of the State, every county, municipality, or other political subdivision of the State, or an authority, board, body, agency, district, commission, or instrumentality of the county, municipality, or subdivision, and  every board of education, or an agency or instrumentality thereof, provide and make available to the public the following information concerning any person, employed in a full or part-time position with that public entity, who has regular and direct contact with the general public as a service provider or in providing a service: (1) the record with respect to all customer complaints made concerning that employee, including any safety violation; (2)  a description of any disciplinary action taken by the public entity against that employee, including, discharge or suspension; and (3) any other information relating to the performance of that employee that the public entity routinely compiles.
