     Provides that sensors required on newly-manufactured school buses be placed around bus in accordance with National Highway Traffic Safety Administration guidelines and will not be required until one year following enactment of original law.

An Act concerning school bus sensors and amending P.L.2015, c.266.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Section 2 of P.L.2015, c.266 (C.39:3B-26) is amended to read as follows:

     2.    Each school bus as defined in R.S.39:1-1 shall be equipped with [a sensor] weather-resistant sensors placed around the bus in accordance with safety guidelines set forth by the National Highway Traffic Safety Administration to determine the presence of objects [in the front or back of] around the bus.  The design and installation of the [sensor] sensors shall conform to regulations to be promulgated by the State Board of Education, in consultation with the Chief Administrator of the New Jersey Motor Vehicle Commission in the Department of Transportation, pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.).

     2.    Section 3 of P.L.2015, c.266 is amended to read as follows:

     3.    This act shall take effect immediately and shall be applicable to school buses manufactured on or after [the 180th day] one year following the date of enactment.

STATEMENT

 

     P.L.2015, c.266 (C.39:3B-26), which was approved on January 19, 2016, requires each school bus manufactured on or after the 180th day following the law's enactment to be equipped with a sensor to alert a bus driver to the presence of objects in front or back of the bus.  The State Board of Education, in consultation with the Chief Administrator of the New Jersey Motor Vehicle Commission, was directed to promulgate regulations on the design and installation of the sensor.

     This bill provides that school bus sensors must be weather-resistant, and are to be placed around the bus in accordance with safety guidelines set forth by the National Highway Traffic Safety Administration.  The sensors must be able to determine the presence of objects around the bus as opposed to only in the front or rear of the bus.

     The bill also provides that the law's provisions will first be applicable to school buses manufactured on or after one year following the date of enactment of P.L.2015, c.266, rather than the 180th day after enactment as provided in the original law.
