SYNOPSIS
Provides exemption for licensed pesticide applicators from certain training, examination, and fees required for fertilizer applicator certification.

An Act concerning an exemption from fertilizer application certification requirements, and supplementing P.L.2010, c.112 (C.58:10A-61 et seq.).
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. Notwithstanding the provisions of section 4 of P.L.2010, c.112 (C.58:10A-64) to the contrary, any person who files, within one year after the effective date of P.L. , c. (C. ) (pending before the Legislature as this bill), an application for certification under section 4 of P.L.2010, c.112 (C.58:10A-64), and demonstrates to the satisfaction of the New Jersey Agricultural Experiment Station that the person has been certified and licensed as a commercial pesticide applicator by the Department of Environmental Protection for at least 10 years immediately preceding the filing of the application, and has not been convicted of, or plead guilty to, an environmental crime or any similar or related criminal offense under federal or state law, shall be certified as a professional fertilizer applicator without additional training, examination, or payment of a certification fee. A person certified pursuant to this section shall comply with any continuing education or training required for certified professional fertilizer applicators, including the payment of any fees therefor.
As used in this section, "environmental crime" shall have the same meaning as provided in section 2 of P.L.2009, c.60 (C.58:10C-2).
2. This act shall take effect immediately.
STATEMENT
This bill would provide that any person who files an application within one year after the effective date of this bill, to be a certified professional fertilizer applicator pursuant to section 4 of P.L.2010, c.112 (C.58:10A-64), and demonstrates to the satisfaction of the New Jersey Agricultural Experiment Station that the applicant has been certified and licensed as a commercial pesticide applicator by the Department of Environmental Protection for at least 10 years immediately preceding the filing of the application, and has not been convicted of, or plead guilty to, an environmental crime or any similar or related criminal offense under federal or state law, would be certified as a professional fertilizer applicator without additional training, examination, or payment of a certification fee. A person so certified would be required to comply with any continuing education or training required for certified professional fertilizer applicators, including the payment of any fees therefor.
