An Act concerning civil service make-up examinations and supplementing Title 11A of the New Jersey Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. Notwithstanding any law, rule or regulation to the contrary, a make-up examination shall be administered, to the extent possible, under the same conditions as the original examination but shall not include the same questions as the original examination.
2. This act shall take effect immediately.
STATEMENT
This bill provides that civil service make-up examinations must be administered, to the extent possible, under the same conditions as the original examination but must not include the same questions as the original examination.
At present, the Department of Personnel does give the same examination, with the same questions, when administering a make-up examination. This practice encourages cheating and, thus, can give an unfair advantage to those persons who take the make-up examination as opposed to those persons who took the original examination.
This issue is now pending before the New Jersey Supreme Court since there is no explicit legislative prohibition against this practice.
