SYNOPSIS

     Requires that adoption or revision of program, policy, or regulation by the State Board, Commissioner, or Department of Education be based on documented evidence that it leads to positive educational outcomes.

An Act concerning public education programs, policies, and regulations and supplementing chapter 4 of Title 18A of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  On and after the effective date of P.L.   , c.     (C.      ) (pending before the Legislature as this bill), the State Board of Education and the Commissioner and the Department of Education shall not initiate a new program or policy, revise an existing program or policy, or adopt or readopt a regulation unless the adoption, revision, or readoption is based on generally accepted research or other documented evidence that links it to increases in student achievement or other positive educational outcomes.

     b.    The State board, commissioner, or department shall provide information on the research or other documented evidence required pursuant to subsection a. of this section to the public, and to the Legislature pursuant to section 2 of P.L.1991, c.164 (C.52:14-19.1), at least 60 days prior to the adoption or revision of a program, policy, or regulation.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill provides that upon its effective date, the State Board of Education and the Commissioner and the Department of Education may not initiate a new program or policy, revise an existing program or policy, or adopt or readopt a regulation unless the adoption, revision, or readoption is based on generally accepted research or other documented evidence that links it to increases in student achievement or other positive educational outcomes.

     Under the bill's provisions, the State board, commissioner, or department must provide the information on the research or other documented evidence to the Legislature and to the public at least 60 days prior to the adoption or revision of the program, policy, or regulation.
