SYNOPSIS
Directs State Board of Examiners to maintain list of certificate holders against whom the board has initiated certificate suspension or revocation proceedings.

An Act concerning licensed school personnel and supplementing chapter 6 of Title 18A of the New Jersey Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. a. The State Board of Examiners shall maintain a list of the names of all individuals holding an instructional, administrative, or educational services certificate against whom the board has initiated certificate suspension or certificate revocation proceedings. A board of education, prior to hiring a candidate for employment as a teaching staff member, shall submit an inquiry to the State Board of Examiners regarding whether the candidate's name appears on the list. If a state educational agency or local educational agency located out-of-State submits an inquiry to the State Board of Examiners regarding whether the name of a candidate for employment with that agency appears on the list, the State board shall provide the information to the out-of-State educational agency.
b. The State Board of Examiners shall remove a person's name from the list maintained under subsection a. of this section following completion of the certificate suspension or certificate revocation proceedings.
2. This act shall take effect immediately.
STATEMENT
This bill directs the State Board of Examiners to maintain a list containing the names of all individuals holding an instructional, administrative, or educational services certificate against whom the board has initiated certificate suspension or certificate revocation proceedings. Under the bill, a board of education must submit an inquiry to the State Board of Examiners prior to hiring a candidate for employment as a teaching staff member in order to learn whether the candidate's name appears on the list. In addition, the bill provides that the State board must respond to an inquiry from a state educational agency or local educational agency located out-of-State regarding whether the name of a candidate for employment with that agency appears on the list. A person's name will remain on the list until the completion of the certificate suspension or certificate revocation proceedings.
This bill will allow a board of education to easily obtain information regarding whether a job applicant's teaching license is in jeopardy before the board of education hires the applicant.
