Clarifies current law regarding noisy motor vehicle muffler; establishes penalty for commercial motor vehicle operators.

An Act concerning motor vehicles, supplementing Title 39 of the Revised Statutes and amending R.S.39:3-70.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. R.S.39:3-70 is amended to read as follows:
39:3-70. Every motor vehicle having a combustion motor shall at all times be equipped with a muffler in good working order and in constant operation to prevent excessive or unusual noise [and] , or annoying smoke[, and no]. No person shall use a muffler cut-out, bypass or similar device upon a motor vehicle on a highway.

2. (New section) Any person who operates a commercial motor vehicle as defined in R.S.39:1-1 that is equipped with a muffler that is knowingly or purposely designed, altered, modified, or disabled in order to produce excessive or unusual noise, or annoying smoke shall be subject of a fine of not less than $60 or more than $500.
3. This act shall take effect immediately.
STATEMENT
This bill updates current law to clarify that a motor vehicle operator is in violation of the motor vehicle code when their muffler is not preventing excessive or unusual noise, or annoying smoke.
In addition, this bill establishes a penalty for a person who operates a commercial motor vehicle that is equipped with a muffler that was knowingly or purposely designed, altered, modified, or disabled in order to produce excessive or unusual noise, or annoying smoke. Under the provisions of this bill, a person who knowingly or purposely commits this violation is subject to a fine of not less than $60 or more than $500.
