SYNOPSIS
Allows dogs in sampling and tasting areas of breweries.

An Act concerning breweries and supplementing Title 33 of the Revised Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. The holder of a limited brewery license issued pursuant to R.S.33:1-10 may allow dogs in any area of the licensed premises designated for the consumption of brewed products, provided that:
a. the owner or operator of the brewery elects to allow dogs to be present in the area of the licensed premises designated for the consumption of brewed products;
b. dogs shall not have access to any area of the licensed premises where the presence of the dog would present a risk of contamination of brewed products or other products produced for human consumption by the brewery;
c. the area of the licensed premises designated for the consumption of brewed products where dogs are allowed can be accessed without passing through any areas of the licensed premises where the presence of a dog would present a risk of contamination of brewed products or other products produced for human consumption by the brewery;
d. the presence of dogs in the area of the licensed premises designated for the consumption of brewed products shall not result in contamination of any clean equipment, glassware, utensils, or other articles used in connection with furnishing samples of brewed products to consumers;
e. staff members are not allowed, while on duty, to have any direct contact with dogs, and any staff member who does have direct contact with a dog while on duty shall promptly wash the staff member's hands in accordance with State public health and sanitation requirements;
f. the area of the licensed premises that is designated for the consumption of brewed products is maintained in a clean condition, and surfaces that have been contaminated by a dog's excrement or bodily fluids are promptly cleaned and sanitized;
g. any food or water provided to dogs while on the licensed premises is in a single-use, disposable container; and
h. the dog is on a leash or confined in a pet carrier and is under the control of its owner at all times while the dog is present in the designated area of the licensed premises.
2. This act shall take
effect immediately.
STATEMENT
This bill allows dogs in certain areas of licensed microbreweries that are designated for the consumption of brewed products, provided that the brewery owner has elected to allow dogs on the premises, dogs will not have access to any areas of the premises where the dog would present a risk of contamination of products intended for human consumption, and the presence of dogs will not present a risk of contaminating any clean equipment, glassware, or related articles in the area designated for the consumption of brewed products. The designated area will be required to be maintained in a clean condition, and any surfaces contaminated by dog excrement or bodily fluids are to be promptly cleansed and sanitized. Staff members will not be allowed to have any direct contact with dogs while the staff members are on duty, and will be required to promptly wash their hands following any direct contact with a dog. Dogs will be required to be on a leash or in a carrier and under the owner's control at all times, and any food or water provided to dogs will be required to be in a single-use, disposable container.
