A Supplement to "An Act making appropriations for the support of the State Government and the several public purposes for the fiscal year ending June 30, 2018 and regulating the disbursement thereof," approved July 4, 2017 (P.L.2017, c.99).
Be It Enacted by the Senate and the General Assembly of the State of New Jersey:
1. Notwithstanding the provisions of P.L.1984, c.73 (C27:1B-1 et al.), or any other law or regulation to the contrary, in addition to the amounts appropriated under P.L.2017, c.99, the annual appropriations act for fiscal year 2018, there is appropriated the sum of $161,950,000 from the amounts on deposit in the Transportation Trust Fund Subaccount for Capital Reserves for capital purposes as follows:

2. This act shall take effect immediately.
STATEMENT
This bill appropriates a total of $161,950,000 out of the Transportation Trust Fund Subaccount for Capital Reserves, of which $76,450,000 is appropriated to the Department of Transportation for the purposes of repairing roads and bridges across the State, and $85,500,000 is appropriated to the New Jersey Transit Corporation for the purposes of increasing transit capacity and safety.
This appropriation funds the projects on a pay-as-you-go basis, utilizing constitutionally dedicated sources of Motor Fuels Tax, Petroleum Products Gross Receipts Tax, and Sales and Use Tax revenues currently deposited in the Transportation Trust Fund Subaccount for Capital Reserves, a reserve subaccount within the General Fund. These constitutionally dedicated revenues are required to be used for the purposes of paying or financing the cost of planning, acquisition, engineering, construction, reconstruction, repair and rehabilitation of the transportation system in this State. It is intended that all of the above transportation capital projects conform to this requirement.
