     Prohibits distribution of campaign materials at any facility owned, maintained, operated or leased by unit of local government.

An Act prohibiting the distribution of campaign materials in the offices and buildings of units of local government, and supplementing chapter 34 of Title 19 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a. No candidate for any elective public office in this State, or the candidate committee or joint candidates committee or any official or other individual associated with such a committee, and no individual, group, association, organization, committee, political committee or continuing political committee, shall transmit for distribution or distribute to an office, building or facility of any kind owned, maintained, operated or leased by a unit of local government, any campaign materials that advocate the nomination, election or defeat of any candidate for elective public office or the passage or defeat of any public question.

     b.    As used in this section:

     (1)   the term "campaign materials" means any button, pin, bumper sticker, book, pamphlet, flyer, brochure, poster, circular, yard sign, palm card or printed or published material of any description, or any audio or video recording, produced by a candidate for any elective public office in this State, or the candidate committee or joint candidates committee or any official or other individual associated with such a committee, or by an individual, group, association, organization, committee, political committee or continuing political committee, that states a position or expresses an opinion with respect to the campaign of a candidate for elective public office or a public question; and

     (2)   the terms "candidate," "candidate committee," "joint candidates committee," "political committee," and "continuing political committee" shall be defined in the same manner as the terms are defined in section 3 of P.L.1973, c.83 (C.19:44A-1 et seq.).

     c.     In addition to any penalty prescribed by law, any individual, group, association, organization, or committee found in violation of subsection a. of this section shall be liable to a penalty of not less than $5,000 for each such violation.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     The purpose of this bill is to prohibit the distribution of campaign materials at any office, building or other facility owned, maintained, operated or leased by a unit of local government.

     Specifically, the bill provides that no candidate for any elective public office in this State, or a committee or individual associated with the candidate, and no individual, group, association, organization, committee, political committee or continuing political committee, is permitted to transmit for distribution or distribute to an office, building or facility of any kind owned, maintained, operated or leased by a unit of local government, any campaign materials that advocate the nomination, election or defeat of any candidate for elective public office or the passage or defeat of any public question.

     The bill defines the term campaign materials to mean any button, pin, bumper sticker, book, pamphlet, flyer, brochure, poster, circular, yard sign, palm card or printed or published material of any description, or any audio or video recording, produced by a candidate for any elective public office in this State, or the candidate committee or joint candidates committee or any official or other individual associated with such a committee, or by an individual, group, association, organization, committee, political committee or continuing political committee, that states a position or expresses an opinion with respect to the campaign of a candidate for elective public office or a public question.
