Revises tenure for public school janitors and establishes tenure for certified educational facilities managers.

An Act concerning tenure for certain public school employees, amending N.J.S.18A:17-3, and supplementing chapter 17 of Title 18A of the New Jersey Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. N.J.S.18A:17-3 is amended to read as follows:
18A:17-3. Every public school janitor of a school district shall, unless he is appointed for a fixed term, hold his office, position or employment under tenure during good behavior and efficiency and shall not be dismissed or suspended or reduced in compensation, except as the result of the reduction of the number of janitors in the district made in accordance with the provisions of this title or except for neglect, misbehavior or other offense and only in the manner prescribed by subarticle B of article 2 of chapter 6 of this title, after employment in such district for:
a. Two consecutive calendar years; or
b. Two consecutive academic years, together with employment at the beginning of the next succeeding academic year; or
c. The equivalent of more than two academic years within a period of any three consecutive academic years.

2. (New section) A certified educational facilities manager of a school district shall hold his office, position, or employment under tenure during good behavior and efficiency and shall not be dismissed or suspended or reduced in compensation, except for neglect, misbehavior or other offense and only in the manner prescribed by subarticle B of article 2 of chapter 6 of this title, after employment in such district for:
a. Two consecutive calendar years; or
b. Two consecutive academic years, together with employment at the beginning of the next succeeding academic year; or
c. The equivalent of more than two academic years within a period of any three consecutive academic years.
3. This act shall take effect immediately.
STATEMENT
Under current law, a public
school janitor, unless appointed for a fixed term, is eligible for tenure immediately.
This bill will limit
tenure eligibility for a public school janitor to a janitor who, unless appointed for a fixed term, is employed with a school district for: (1) two consecutive calendar years; or (2) two consecutive academic years, together with employment at the beginning of the next succeeding academic year; or (3) the equivalent of more than two academic years within a period of any three consecutive academic years.
Currently, certified educational facilities managers are not eligible for tenure. Under this bill, a certified educational facilities manager will be eligible for tenure after employment in a school district for: (1) two consecutive calendar years; or (2) two consecutive academic years, together with employment at the beginning of the next succeeding academic year; or (3) the equivalent of more than two academic years within a period of any three consecutive academic years.
