SYNOPSIS

     Memorializes Congress to phase-out certain aircraft.

An Assembly Resolution memorializing the United States Congress to phase-out Stage 1 and Stage 2 aircraft weighing less than 75,000 pounds.

 

Whereas, The United States Congress determined that local concerns regarding noise pollution resulting from aviation travel led to uncoordinated and inconsistent restrictions upon  the national aviation system which, if left unchecked, would have posed an impediment to the national air transportation system; and

Whereas, As a result, Congress enacted the federal "Airport Noise and Capacity Act of 1990," Pub.L.103-272 (49 U.S.C. s.47521 et seq.), setting forth a national scheme for  reducing excessive air noise by phasing-out older, less efficient, louder aircraft from air travel; and

Whereas, Congress required the U.S. Secretary of Transportation to establish by regulation the provision of a ten-year time-frame in which Stage 1 and Stage 2 aircraft weighing more than 75,000 pounds, namely commercial aircraft, were to be removed from service or undergo mechanical alterations which would reduce the level of noise produced, qualifying the aircraft for Stage 3 classification; and 

Whereas, This Congressional mandate exempted certain types of smaller Stage 1 and Stage 2 aircraft, often used for corporate or business travel,  and which utilize general aviation airports in this State and throughout the country, from the phase-out time-frame; and

Whereas, These aircraft, not subject to the federal "Airport Noise and Capacity Act of 1990," generate an inordinate amount of excessive noise, yet, federal law and regulation restricts the actions that airport operators and the State may take in limiting these aircraft that produce such excessive noise; and

Whereas, As a result, those New Jersey residents living in the neighborhoods surrounding general aviation airports, especially  near Teterboro Airport and Morristown Municipal Airport, have not experienced the same level of relief from excessive air noise as those individuals living in proximity to commercial airports; and

Whereas, The quality of life for many New Jersey citizens would vastly improve should Congress phase-out Stage 1 and Stage 2 aircraft, weighing less than 75,000 pounds, that remain in service and which generate excessive noise in the areas surrounding general aviation airports in this State; now, therefore,

 

     Be It Resolved by the General Assembly of the State of New Jersey:


     1.    The General Assembly hereby memorializes the United States Congress to immediately commence phasing-out the remaining Stage 1 and Stage 2 aircraft, weighing less than 75,000 pounds, that generate excessive air noise and diminish the quality of life for so many residents of New Jersey.

 

     2.    Duly authenticated copies of this resolution, signed by the Speaker of the General Assembly and attested by the Clerk thereof,

shall be transmitted to the President of the United States Senate, the Speaker of the United States House of Representatives, each member of Congress from the State of New Jersey, and to the U.S. Secretary of Transportation.

     This Assembly resolution memorializes the United States Congress to immediately commence phasing-out the remaining Stage 1 and Stage 2 aircraft, weighing less than 75,000 pounds, that generate excessive air noise and diminish the quality of life for so many residents of New Jersey.
