SYNOPSIS

     Requires DEP to test certain DEP water wells and monitoring stations and report results thereof.

An Act concerning the testing of certain wells by the Department of Environmental Protection and supplementing Title 58 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    At least once each year, the Department of Environmental Protection shall sample and test each well or water monitoring station that is owned or operated by the department.  Each sample shall be tested in accordance with the standards established pursuant to the "Safe Drinking Water Act," P.L.1977, c.224 (C.58:12A-1 et seq.).

     The department shall post on its Internet website the location of each well or water monitoring station tested, the date and time the well or water monitoring station was tested, and the use or purpose of the well.

     For any well or water monitoring station tested that does not meet the standards established pursuant to the "Safe Drinking Water Act," the DEP shall provide written notice to the governing bodies of the municipality and county and the legislators representing the district in which the well or water monitoring station is located. This notice shall also be provided to local media serving the area in which the well or water monitoring station is located.  This notice shall provide a clear explanation of the use or purpose of the well or water monitoring station and the reason why the sample does not meet the "Safe Drinking Water Act" standards.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill would require the Department of Environmental Protection (DEP) to sample each well and water monitoring station that it owns or operates at least once every year, and further requires that the samples be tested in accordance with the standards adopted by the DEP pursuant to the "Safe Drinking Water Act," P.L.1977, c.224 (N.J.S.A.58:12A-1 et seq.).

     The DEP would be required to report on its website the location of each well or water monitoring station tested, the date and time the well or water monitoring station was tested, and the use or purpose of the well or water monitoring station.  If any well or water monitoring station tested does not meet the "Safe Drinking Water Act" standards, the DEP would be required to provide notice to the governing bodies of the municipality and county and the legislators representing the district in which the well or water monitoring station is located and local media serving the area in which the well or water monitoring station is located.  This notice would include an explanation of the use or purpose of the well or water monitoring station and the reasons why it did not meet the "Safe Drinking Water Act" standards.
