SYNOPSIS

     Requires Division of Purchase and Property to provide additional notification of contracting opportunities to vendors or potential vendors providing or interested in providing home health care services to State agencies.

An Act requiring additional notification be provided about certain public contracting opportunities, and supplementing chapter 34 of Title 52 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Notwithstanding the provisions of any statute, or rule or regulation to the contrary, the Director of the Division of Purchase and Property in the Department of the Treasury shall provide public notification in a timely manner concerning applications, renewals, deadlines, reprocurement bidding. new contracts, or the extension of existing contracts to those vendors or potential vendors that provide, or are seeking an agreement or contract to provide, home health care services to State agencies using such services.  This notification to vendors and potential vendors shall be in addition to the notification of contracting opportunities for such services required pursuant to current law or regulation.

     The notification shall be:

     a.     posted on the Internet website of the division at a location where such information is updated regularly and easily accessible;

     b.    provided to vendors or potential vendors who are under contract to provide such services to State agencies at the time additional or new information regarding increased contracting opportunities becomes available;

     c.     provided to persons or business entities that have shown an interest in receiving such information as it becomes available by providing contact information to the division; and

     d.    provided to any other vendor or potential vendor requesting such information who is not barred or otherwise ineligible from bidding for or receiving a public contract.

     In addition to being posted on the Internet website of the division, the director shall provide notification in a timely manner to all interested and eligible vendors and potential vendors in at least two of the following forms, as may be determined by the director on a case by case basis: direct communication with the vendor or potential vendor by telephone, fax or other electronic telecommunication device, direct communication by e-mail from the division to the vendor or potential vendor, or by certified letter from the division to the vendor or potential vendor.

 

     2.    This act shall take effect on the 60th day following the date of enactment.


STATEMENT

 

     This bill requires the Director of the Division of Purchase and Property in the Department of the Treasury to provide additional notification of contracting opportunities to vendors or potential vendors who are providing or are interested in providing home health care services to those State agencies who use such services.

     Under the bill, the notification would be:

     1)    posted on the Internet website of the division at a location where such information is updated regularly and easily accessible;

     2)    provided to vendors or potential vendors who are under contract to provide such services to State agencies at the time additional or new information regarding increased contracting opportunities becomes available;

     3)    provided to persons or business entities that have shown an interest in receiving such information as it becomes available by providing contact information to the division; and

     4)    provided to any other vendor or potential vendor requesting such information who is not barred or otherwise ineligible from bidding for or receiving a public contract.  This notification to vendors and potential vendors would be in addition to the notification of contracting opportunities for such services required pursuant to current law or regulation.
