SYNOPSIS
Establishes eligibility and staffing requirements for pediatric medical day care facilities.

An Act concerning pediatric medical day care services and supplementing Title 26 of the Revised Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. A pediatric medical day care facility licensed by the Department of Health and Senior Services shall be subject to the following requirements:
a. A facility shall serve: medically-complex children who exhibit a severity of illness that requires ongoing skilled nursing intervention; technology-dependent children who require specific medical devices to compensate for the loss of a vital body function to avert death or further disability and ongoing skilled nursing intervention in the use of the device; and children with chronic health conditions who require facility services for stabilization and rehabilitation of their conditions.
b. Medicaid reimbursement for pediatric medical day care services shall not be subject to prior authorization requirements.
c. The number of medical day care slots permitted at a facility shall be determined on a facility-by-facility basis, using a square footage formula.
d. A facility shall be responsible for providing transportation services daily for children who attend the facility, but shall not be required to transport the children in mobility assistance vehicles.
e. Preliminary physical examinations of children who attend a facility may be performed by the child's primary care provider or by an advance practice nurse employed by the facility.
f. To the extent practical, registered professional nurses and licensed practical nurses employed by a facility shall have professional experience working with medically-complex children; the staffing ratio at a facility shall not exceed one nurse for every three children; and at least one registered professional nurse shall be on site at the facility at all times when children are present.
2. The Commissioner of Health and Senior Services, in consultation with the Commissioner of Human Services, shall adopt rules and regulations necessary to carry out the purposes of this act, pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.).
3. This act shall take effect on the 90th day following enactment, but the Commissioner of Health and Senior Services may take such anticipatory administrative action in advance thereof as shall be necessary for the implementation of this act.
STATEMENT
This bill establishes reasonable requirements for determining a child's eligibility for attendance at a pediatric medical day care (PMDC) facility and for nurse staffing at the facilities. The PMDCs are licensed by the Department of Health and Senior Services. Specifically, the bill requires the following:
