     Amends FY 2011 appropriations act to provide supplemental appropriation of $5,599,000 to the Department of Human Services for orthodontic care for children and kinship care initiatives.

AN ACT amending the Fiscal Year 2011 annual appropriations act, P.L.2010, c.   .

 

     Be It Enacted by the Senate and the General Assembly of the State of New Jersey:

 

     1.    The following items and language provision in section 1 of P.L.2010, c.  , the annual appropriations act for State fiscal year 2011, are amended to read as follows:

[Notwithstanding the provisions of any law or regulation to the contrary, of the amounts hereinabove appropriated in Managed Care Initiative, Payments for Medical Assistance Recipients - Dental Services, and NJ FamilyCare ‑ Affordable and Accessible Health Coverage Benefits, no payment shall be expended on orthodontic services for children except in cases where medical necessity can be proven, such as cases involving birth defects, facial deformities causing functional difficulties in speech and mastication, and trauma.]

     2.    This act shall take effect July 1, 2010 but remain inoperative until the date of enactment of P.L.2010, c.   (the annual appropriation act for the fiscal year ending on June 30, 2011).


STATEMENT

 

     This bill amends the Fiscal Year 2011 appropriations act to provide supplemental funding of $5,599,000 to the Department of Human Services for orthodontic care for children under the State Medicaid program and for kinship care initiatives in the Division of Family Development.

     Specifically, the bill provides an additional $3,803,000 for dental services for children and eliminates language, initiated by the Governor in his proposed budget, which precludes coverage for orthodontic services for children covered under Medicaid and NJ FamilyCare in most circumstances.  Under the language being eliminated, only children's orthodontic services deemed "medically necessary" would be covered.

     The bill would also provide an additional $1,796,000 for kinship care "wrap around" grants which the Governor's FY 2011 budget cut in half. These grants, which are provided to individuals who provide kinship care for the children of relatives, ultimately results in significant savings to the State by reducing placements in the more costly foster care system.
