SYNOPSIS

     Provides that 1.5% contribution required to be made by certain public employees will not take effect until expiration of collective bargaining agreement made applicable to such employees.

An Act concerning the contribution required of certain public employees for health care benefits.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.  The contribution of 1.5 percent of base salary for health care benefits coverage that is required to be made by certain public employees of local boards of education, local units or agencies thereof, or county colleges in accordance with sections 13 and 14 of P.L.2010, c.2 as amending section 6 of P.L.1979, c.391 (C.18A:16-17) and N.J.S.40A:10-23, and in accordance with section 16 of P.L.2010, c.2 (C.18A:64A-13.1a), shall take effect for employees for whom there is no majority representative for collective negotiations purposes upon the expiration of any applicable binding collective negotiations agreement in force on the effective date of P.L.2010, c.2 that the employer has applied on, or prior to, that effective date to modify the respective payment obligations of the employer and those employees in a manner consistent with the terms of that applicable collective negotiations agreement binding on the employer.

 

     2.  This act shall take effect immediately and shall be retroactive to the effective date of P.L.2010, c.2.

 

 

STATEMENT

 

     This bill provides that the contribution of 1.5 percent of base salary for health care benefits coverage that is required to be made by certain public employees of local boards of education, local units or agencies thereof, or county colleges in accordance with P.L.2010, c.2 will take effect for employees for whom there is no majority representative for collective negotiations purposes upon the expiration of any applicable binding collective negotiations agreement in force on the effective date of P.L.2010, c.2 that the employer has applied on, or prior to, that effective date to modify the respective payment obligations of the employer and those employees in a manner consistent with the terms of that applicable collective negotiations agreement binding on the employer.  This bill applies to public employers and their employees who do not participate in the State Health Benefits Program or the School Employees' Health Benefits Program.  The Department of Community Affairs has interpreted P.L.2010, c.2 to provide for the commencement of the 1.5 percent contribution for these employees on May 21, 2010.

     This bill will be effective immediately upon enactment and will be retroactive to the effective date of P.L.2010, c.2.
