Makes supplemental appropriation of $12,960,000 to DOE for additional State aid to certain school districts.

A Supplement to "An Act making appropriations for the support of the State Government and the several public purposes for the fiscal year ending June 30, 2015 and regulating the disbursement thereof," approved June 30, 2014 (P.L.2014, c.14).
Be It Enacted by the Senate and the General Assembly of the State of New Jersey:
1. In addition to the amounts appropriated under P.L.2014, c.14, there is appropriated out of the General Fund the following sum for the purpose specified:

Notwithstanding the provisions of any law or regulation to the contrary, the amount hereinabove appropriated for under adequacy aid shall be awarded to a school district, other than a non-operating school district or a county vocational school district, in which the district's spending is more than 10% below the district's adequacy threshold. A school district's spending shall be calculated as, from the prior budget year, the sum of the school district's general fund tax levy, equalization aid, special education categorical aid, security aid, and adjustment aid. The school district's adequacy threshold shall be calculated as, from the current budget year, the sum of the school district's adequacy budget, as calculated pursuant to section 9 of P.L.2007, c.260 (C.18A:7F-51), special education categorical aid, as calculated pursuant to section 13 of P.L.2007, c.260 (C.18A:7F-55), and security categorical aid, as calculated pursuant to section 14 of P.L.2007, c.260 (C.18A:7F-56). A school district shall receive under adequacy aid in an amount equal to the difference between the district's spending and adequacy threshold, multiplied by the district's under adequacy rate. A school district's under adequacy rate shall equal the percent difference between the district's spending and adequacy threshold minus 10 percentage points, multiplied by 0.20. In the case of a school district in which the resident enrollment increased by at least 13% between October 2008 and October 2013, under adequacy aid shall not exceed $250,000. In all other school districts, under adequacy aid shall not exceed $100,000.
2. This act shall take effect immediately.
STATEMENT
This bill provides a supplemental appropriation to the Department of Education to provide additional State aid to certain school districts. The aid, known as under adequacy aid, would be awarded to school districts in which the district's spending is more than 10 percent below its adequacy threshold. The district's spending is defined as, from the prior budget year, the sum of the general fund tax levy, equalization aid, special education categorical aid, security categorical aid, and adjustment aid. The adequacy threshold is defined as, for the current budget year, the sum of district's adequacy budget, special education categorical aid, and security categorical aid.
Under adequacy aid is calculated as the difference between the district's spending and adequacy threshold, multiplied by the under adequacy rate. The under adequacy rate is the percent difference between the district's spending and adequacy threshold, reduced by 10 percentage points, and multiplied by 0.20. The maximum aid amount would equal $250,000 in the case of a school district in which the resident enrollment increased by at least 13 percent between October 2008 and October 2013; for all other districts, the maximum aid amount would be $100,000.
