SYNOPSIS
Grants immunity from liability to institutions of higher education and certain employees for damages resulting from novel coronavirus disease.

An Act granting immunity from liability to institutions of higher education and their employees for certain claims and supplementing Title 18A of the New Jersey Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. Notwithstanding any provision of law to the contrary, no institution of higher education or an employee, agent, representative or designee of an institution, shall be liable in any action for damages to any person that result from the institution's or employee's, agent's, representative's, or designee's decision to perform or not to perform any act to prevent, control, or eliminate the spread of the novel coronavirus disease. Nothing in this section shall be deemed to grant immunity to any person causing damage by his willful, wanton or grossly negligent act of commission or omission.
2. This act shall take effect immediately.
STATEMENT
This bill grants immunity from liability to an institution of higher education and an employee, agent, representative, or designee of the institution in any action for damages to any person that result from a decision to perform or not perform any act to prevent, control, or eliminate the spread of the novel coronavirus disease. The bill does not provide immunity when an institution or employee causes damage through willful, wanton, or grossly negligent acts of commission or omission.
