SYNOPSIS

     Prohibits public institutions of higher education from accepting gifts and donations from foreign adversaries.

An Act concerning public institutions of higher education and supplementing chapter 62 of Title 18A of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a. As used in this section, "foreign adversary" means any foreign government or foreign non-government person determined by the United States Secretary of Commerce to have engaged in a long-term pattern or serious instances of conduct significantly adverse to the national security of the United States or security and safety of United States persons.

     b.  A public institution of higher education shall be prohibited from accepting a gift or donation from a foreign adversary, an individual acting on behalf of a foreign adversary, or an entity that is owned, controlled, or subject to a jurisdiction deemed a foreign adversary.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill prohibits public institutions of higher education from accepting gifts and donations from certain entities and individuals.

     Under the bill, a public institution of higher education is prohibited from accepting gifts and donations from a foreign adversary, an individual acting on behalf of a foreign adversary, or an entity that is owned, controlled, or subject to a jurisdiction deemed a foreign adversary.

     The bill defines foreign adversary as any foreign government or foreign non-government person determined by the United States Secretary of Commerce to have engaged in a long-term pattern or serious instances of conduct significantly adverse to the national security of the United States or security and safety of United States persons.
