     Authorizes educational services commissions to apply for grant for State share of school facilities projects.

An Act concerning certain school facilities projects and supplementing P.L.2000, c.72 (C.18A:7G-1 et al.).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  Notwithstanding the provisions of P.L.2000, c.72 (C.18A:7G-1 et al.) or any other law, rule, or regulation to the contrary, an educational services commission may apply for a grant under section 15 of P.L.2000, c.72 (C.18A:7G-15) for the State share of any school facilities project approved by the Commissioner of Education.  The State share payable to the educational services commission shall equal 40 percent of the project's cost.

     b.    The commissioner shall allocate grant funding to the educational services commission in accordance with the process established under subsection b. of section 15 of P.L.2000, c.72 (C.18A:7G-15).

     c.     The New Jersey Schools Development Authority shall provide grant funding for the State share of the cost of the school facilities project pursuant to an agreement between the educational services commission and the development authority.  The agreement, in addition to other terms and conditions, shall set forth the terms of disbursement of the State share.  The funding of the State share shall not commence until the commission secures financing for the local share.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill authorizes an educational services commission to apply for a grant under section 15 of the "Educational Facilities Construction and Financing Act," P.L.2000, c.72 (C.18A:7G-15), for the State share of a school facilities project that has been approved by the commissioner.  The State share is to equal 40 percent of the cost of the project.

     The Commissioner of Education is to allocate grant funding to an educational services commission in accordance with the process established under current law for the allocation of section 15 grants.  The New Jersey Schools Development Authority is to provide the grant funding in accordance with an agreement between the commission and the development authority that will set forth the terms of the disbursement of the State share.  The funding of the State share may not commence until the commission secures financing for the local share.
