LOPEZ, PHEFFER, ROBINSON, WRIGHT -- read once and referred to the Committee on Social Services AN ACT to amend the social services law, in relation to providing the families of the world trade center victims with health benefits THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Subdivision 7 of section 369-ee of the social services law 2 is renumbered subdivision 8 and a new subdivision 7 is added to read as 3 follows: 4 7. NOTWITHSTANDING ANY INCONSISTENT PROVISIONS OF LAW, AN INDIVIDUAL 5 WHO MEETS THE ELIGIBILITY REQUIREMENTS OF SUBPARAGRAPHS (I), (II) OR 6 (III) OF PARAGRAPH (A) OF SUBDIVISION TWO OF THIS SECTION AND IS A 7 SURVIVING VICTIM OF THE WORLD TRADE CENTER ATTACK OF SEPTEMBER ELEVENTH, 8 TWO THOUSAND ONE, OR A SURVIVING SPOUSE OR DEPENDENT OF A DECEASED 9 VICTIM, MAY ENROLL AND RECEIVE HEALTH CARE SERVICES PURSUANT TO THE 10 PROVISIONS OF THIS SECTION; PROVIDED, HOWEVER, THAT THE ELIGIBLE ORGAN- 11 IZATION THROUGH WHICH THE INDIVIDUAL ENROLLS SHALL NOT BE ELIGIBLE TO 12 RECEIVE A SUBSIDY FOR PROVIDING SUCH COVERAGE TO SUCH INDIVIDUAL OR SUCH 13 INDIVIDUAL'S FAMILY. THE COST OF SUCH INDIVIDUAL'S COVERAGE SHALL BE 14 DETERMINED BY THE COMMISSIONER, IN CONSULTATION WITH THE SUPERINTENDENT 15 OF INSURANCE, AND THE REIMBURSEMENT TO SUCH ELIGIBLE ORGANIZATION SHALL 16 BE NO MORE THAN THE COST OF PROVIDING SUCH COVERAGE. 17 S 2. This act shall take effect immediately and shall be deemed to 18 have been in full force and effect on and after March 1, 2003.
