GABRYSZAK, KOON, MAGEE, McENENY, REILLY -- read once and referred to the Committee on Racing and Wagering AN ACT to amend the general municipal law, in relation to authorizing the conducting of event games by organizations authorized to conduct games of chance THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Subdivisions 3, 3-a, 3-d, 9 and 14 of section 186 of the 2 general municipal law, subdivision 3 as amended by section 5 of part B 3 of chapter 383 of the laws of 2001, subdivisions 3-a and 9 as amended 4 and subdivision 3-d as added by chapter 337 of the laws of 1998, and 5 subdivision 14 as amended by chapter 637 of the laws of 1999, are 6 amended and a new subdivision 3-e is added to read as follows: 7 3. "Games of chance" shall mean and include only the games known as 8 "merchandise wheels", "coin boards", "merchandise boards", "seal cards", 9 "EVENT GAMES", "raffles", and "bell jars" and such other specific games 10 as may be authorized by the board, in which prizes are awarded on the 11 basis of a designated winning number or numbers, color or colors, symbol 12 or symbols determined by chance, but not including games commonly known 13 as "bingo or lotto" which are controlled under article fourteen-H of 14 this chapter and also not including "bookmaking", "policy or numbers 15 games" and "lottery" as defined in section 225.00 of the penal law. No 16 game of chance shall involve wagering of money by one player against 17 another player. 18 3-a. "Bell jars" shall mean and include those games in which a partic- 19 ipant shall draw a card from a jar, vending machine, or other suitable 20 device or container which contains numbers, colors or symbols that are 21 covered and which, when uncovered, may reveal that a prize shall be 22 awarded on the basis of a designated winning number, color or symbol or EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD01212-01-9 A. 934 2 1 combination of numbers, colors or symbols. Bell jars shall also include 2 seal cards, coin boards, EVENT GAMES, and merchandise boards. 3 3-d. "Seal cards" shall mean a board or placard used in conjunction 4 with a deal of the same serial number which contains one or more 5 concealed areas that, when removed or opened, reveal a predesignated 6 winning number, letter, or symbol located on the board or placard. A 7 SEAL CARD USED IN CONJUNCTION WITH AN EVENT GAME SHALL NOT BE REQUIRED 8 TO CONTAIN LINES FOR PROSPECTIVE SEAL WINNERS TO SIGN THEIR NAME. 9 3-E. "EVENT GAME" SHALL MEAN A BELL JAR GAME IN WHICH CERTAIN WINNERS 10 ARE DETERMINED BY THE RANDOM SELECTION OF ONE OR MORE BINGO NUMBERS, THE 11 USE OF A SEAL CARD OR BY ANOTHER METHOD APPROVED BY THE BOARD. 12 9. "Single type of game" shall mean the games of chance known as 13 merchandise wheels, coin boards, merchandise boards, EVENT GAMES, 14 raffles, and bell jars and each other specific game of chance authorized 15 by the board. 16 14. "One occasion" shall mean the successive operations of any one 17 single type of game of chance which results in the awarding of a series 18 of prizes amounting to five hundred dollars or four hundred dollars 19 during any one license period, in accordance with the provisions of 20 subdivision eight of section one hundred eighty-nine of this article, as 21 the case may be. For purposes of the game of chance known as a merchan- 22 dise wheel or a raffle, "one occasion" shall mean the successive oper- 23 ations of any one such merchandise wheel or raffle for which the limit 24 on a series of prizes provided by subdivision six of section one hundred 25 eighty-nine of this article shall apply. For purposes of the game of 26 chance known as a bell jar, "one occasion" shall mean the successive 27 operation of any one such bell jar, seal card, EVENT GAME, coin board, 28 or merchandise board which results in the awarding of a series of prizes 29 amounting to three thousand dollars. For the purposes of the game of 30 chance known as raffle "one occasion" shall mean a calendar year during 31 which successive operations of such game are conducted. 32 S 2. This act shall take effect immediately.
