       AN  ACT  to  amend  the  public  housing law, in relation to regulations
         authorizing the issuance of financial penalties
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  The public housing law is amended by adding a new section
    2  229 to read as follows:
    3    S 229. REGULATIONS. NO AUTHORITY, OFFICE  OR  OTHER  ENTITY  OPERATING
    4  PURSUANT  TO THIS CHAPTER SHALL ENACT ANY NEW REGULATION AUTHORIZING THE
    5  ISSUANCE OF A FINANCIAL PENALTY UNLESS:
    6    (A) ALL AFFECTED RESIDENTS ARE NOTIFIED  OF  THE  PROPOSED  REGULATION
    7  WITH A DETAILED DESCRIPTION OF (I) THE PENALTY, (II) WHO HAS THE AUTHOR-
    8  ITY  TO  ISSUE  SUCH  PENALTY,  AND  (III)  HOW  SUCH  PENALTY  SHALL BE
    9  COLLECTED;
   10    (B) A MAJORITY OF THE  AFFECTED  RESIDENTS  APPROVES  SUCH  REGULATION
   11  THROUGH A PAPER BALLOT; AND
   12    (C)  A MAJORITY OF THE BOARD OF DIRECTORS OF SUCH ENTITY APPROVES SUCH
   13  REGULATION.
   14    S 2. This act shall take effect on the sixtieth  day  after  it  shall
   15  have become a law.
