ORTIZ -- read once and referred to the Committee on Codes AN ACT to amend the criminal procedure law, in relation to prohibiting law enforcement agencies and peace officers from inquiring about the nationality or immigration status of a victim or witness to a criminal offense THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. The criminal procedure law is amended by adding a new 2 section 2.25 to read as follows: 3 S 2.25 PROHIBITIONS ON LAW ENFORCEMENT AGENCIES AND PEACE OFFICERS. 4 A LAW ENFORCEMENT AGENCY OF THE STATE OR A POLITICAL SUBDIVISION OF 5 THE STATE OR A PEACE OFFICER MAY NOT INQUIRE AS TO THE NATIONALITY OR 6 IMMIGRATION STATUS OF A VICTIM OF OR WITNESS TO A CRIMINAL OFFENSE 7 EXCEPT AS NECESSARY TO INVESTIGATE THE OFFENSE. 8 S 2.
