       AN ACT to amend the criminal procedure law, in relation  to  prohibiting
         law  enforcement  agencies and peace officers from inquiring about the
         nationality or immigration status of a victim or witness to a criminal
         offense
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  The  criminal  procedure  law  is amended by adding a new
    2  section 2.25 to read as follows:
    3  S 2.25 PROHIBITIONS ON LAW ENFORCEMENT AGENCIES AND PEACE OFFICERS.
    4    A LAW ENFORCEMENT AGENCY OF THE STATE OR A  POLITICAL  SUBDIVISION  OF
    5  THE  STATE  OR  A PEACE OFFICER MAY NOT INQUIRE AS TO THE NATIONALITY OR
    6  IMMIGRATION STATUS OF A VICTIM OF  OR  WITNESS  TO  A  CRIMINAL  OFFENSE
    7  EXCEPT AS NECESSARY TO INVESTIGATE THE OFFENSE.
    8    S 2. This act shall take effect immediately.
