       AN ACT to amend the executive law, in relation to the identification  of
         structures with truss type construction in the city of New York
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Subdivision 5 of section 382-a of  the  executive  law,  as
    2  added by chapter 119 of the laws of 2001, is amended to read as follows:
    3    5.  The  provisions of this section shall not apply to any city with a
    4  population of one million or more persons PROVIDED, HOWEVER, IF  SUCH  A
    5  CITY  ENACTS  OR  ADOPTS  A NEW BUILDING CODE SUBSEQUENT TO THE FIRST OF
    6  JANUARY, TWO THOUSAND NINE, THEN SUCH NEWLY ENACTED OR ADOPTED  BUILDING
    7  CODE  SHALL  CONTAIN NOTICE PROVISIONS WHICH ARE THE SAME AS OR SUBSTAN-
    8  TIALLY SIMILAR TO THE NOTICE PROVISIONS OF THIS  SECTION.  IN  ADDITION,
    9  SUCH NEW BUILDING CODE SHALL CONTAIN IDENTICAL NOTICE PROVISIONS, AS SET
   10  FORTH IN THIS SECTION, FOR RESIDENTIAL STRUCTURES.
   11    S 2. This act shall take effect immediately.
