STATE OF NEW YORK ________________________________________________________________________ 1798 2025-2026 Regular Sessions IN ASSEMBLY January 14, 2025 ___________ Introduced by M. of A. COLTON, EPSTEIN, SAYEGH, DeSTEFANO, ROSENTHAL, WOERNER, DAVILA, STERN, LUPARDO, K. BROWN, SIMON, GANDOLFO -- read once and referred to the Committee on Ways and Means AN ACT to establish a tax credit for electric vehicle charging stations task force to recommend a program for a tax credit for commercial property owners who install electric vehicle charging stations on such property; and providing for the repeal of such provisions upon the expiration thereof The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. A tax credit for electric vehicle charging stations task 2 force (referred to hereinafter as the "task force") to make recommenda- 3 tions on a program for a tax credit for commercial property owners who 4 install electric vehicle charging stations on such commercial property 5 is hereby established. Such tax credit program shall be made available 6 to commercial property owners who charge an hourly rate for the use of 7 such electric vehicle charging station. 8 § 2. a. Such task force shall consist of thirteen members that shall 9 be appointed as follows: two members shall be appointed by the temporary 10 president of the senate, two members shall be appointed by the speaker 11 of the assembly, one member shall be appointed by the minority leader of 12 the senate, one member shall be appointed by the minority leader of the 13 assembly and seven members shall be appointed by the governor. 14 b. Members of the task force shall receive no compensation for their 15 services but shall be reimbursed for their actual expenses incurred in 16 the performance of their duties in the work of the task force. 17 § 3. Appointments shall be made within sixty days of the effective 18 date of this act. Any vacancies in the membership of the task force 19 shall be filled in the same manner provided for in the initial appoint- 20 ment. The task force may consult with any organization, government 2 entity, or person, in the development of its report required under 3 section five of this act. 4 § 5. On or before one year after the effective date of this act, the 5 task force shall submit to the governor and the legislature a report 6 containing, but not limited to, the following recommendations: 7 a. An agency to administer such tax credit program; 8 b. Regulations required to regulate such tax credit program; 9 c. Regulations on the hourly fees for such electric vehicle charging 10 stations on commercial property to qualify the owner of such commercial 11 property for the tax credit program; and 12 d. Other requirements needed for such commercial property owner to 13 apply for such tax credit program. 14 § 6. This act shall take effect immediately and shall expire twenty- 15 four months after it shall have become a law when upon such date the 16 provisions of this act shall be deemed repealed.
