STATE OF NEW YORK ________________________________________________________________________ 1883 2021-2022 Regular Sessions IN ASSEMBLY January 11, 2021 ___________ Introduced by M. of A. CAHILL -- read once and referred to the Committee on Economic Development AN ACT to amend the alcoholic beverage control law, in relation to a license to sell liquor at retail for consumption on certain premises The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 7 of section 64 of the alcoholic beverage 2 control law is amended by adding a new paragraph (e-13) to read as 3 follows: 4 (e-13) Notwithstanding the provisions of paragraph (a) of this subdi- 5 vision, the authority may issue a retail license for on-premises 6 consumption for premises which shall be located within two hundred feet 7 of a building occupied exclusively as a church, synagogue, or other 8 place of worship, provided such premises constitutes a premises for the 9 sale of food or beverages at retail for the consumption on the premises 10 located wholly within the boundaries of the county of Ulster, bounded 11 and described as follows: 12 Beginning at a point marked by an iron rod in the ground at the 13 concrete curb on the southerly side of the State Highway Route 212, also 14 known as Tinker Street, leading through the Hamlet of Woodstock, at the 15 northwesterly corner of the lands now owned by Henry L. Houst adjoining 16 on the east, thence from the said iron rod and point of beginning 17 running along the division line between said lands now owned by Henry L. 18 Houst and the lands here described on a course of south 29 degrees 40 19 minutes west for a distance of 104.00 feet to a steel rod driven in the 20 ground; thence continuing along the last mentioned lands for the follow- 21 ing courses and distances; south 51 degrees 10 minutes east 50.00 feet 22 to a steel rod driven in the ground, thence south 29 degrees 45 minutes 23 west 55.00 feet to an iron rod driven in the ground, thence south 51 24 degrees 11 minutes east 32.00 feet to a steel rod driven in the ground, 25 thence south 36 degrees 06 minutes west 75.00 feet to an iron pipe driv- EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD01259-01-1A. 1883 2 1 en in the ground at the southeasterly corner of the lands herein 2 described, thence running along the lands now or formerly John Wolven 3 north 52 degrees 08 minutes west 73.37 feet to an iron rod driven in the 4 ground, thence running north 29 degrees 54 minutes east 31.50 feet to an 5 iron rod driven in the ground, thence running along lands of the Mower 6 Food Market, now owned by Louis Feinberg north 22 degrees 37 minutes 7 west 143.25 feet to a point at the concrete curb on the southerly side 8 of the State Highway Route 212 or Tinker Street, aforesaid, thence 9 running along the said concrete curb for the following courses and 10 distances; north 68 degrees 24 minutes east 46.37 feet to a point, 11 thence north 70 degrees 19 minutes east 55.50 feet to a point, thence 12 north 74 degrees 12 minutes east 20.00 feet to a point, thence north 78 13 degrees 16 minutes east 16.95 feet to a point, thence north 83 degrees 14 47 minutes east 17.30 feet to a point, thence south 82 degrees 59 15 minutes east 8.00 feet to the point and place of beginning. Containing 16 .481 part of an acre. Subject to the terms of a certain easement and 17 right of way heretobefore granted to the Happy Store Property, now 18 belonging to Louis Feinberg, running along the westerly line of the 19 premises herein described. 20 § 2. This act shall take effect immediately.
