STATE OF NEW YORK ________________________________________________________________________ 1886 2017-2018 Regular Sessions IN ASSEMBLY January 13, 2017 ___________ Introduced by M. of A. CROUCH, FINCH, GIGLIO, OAKS -- read once and referred to the Committee on Education AN ACT in relation to directing the commissioner of education to estab- lish apportionment methods for certain school districts with respect to students with disabilities The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Legislative findings. The legislature finds that students 2 with disabilities often need special accommodations in order to achieve 3 the highest standards of learning. These special accommodations are 4 often associated with high costs. The legislature further finds that 5 when a student with a disability transfers to a new school district 6 within the same school year, the new school district is without funding 7 for such student until the beginning of the next school year. 8 The legislature therefore finds that it is necessary to direct the 9 commissioner of education to establish a method by which a school 10 district may receive necessary aid for students with disabilities at any 11 time, throughout the school year, as may be appropriate. 12 § 2. The commissioner of education is hereby directed to establish a 13 method for apportioning school aid for students with disabilities at any 14 time, throughout the school year, as may be appropriate. 15 § 3. The commissioner of education shall establish a special fund to 16 be used solely for the purpose of supplying interim aid to school 17 districts that are attended by students with disabilities, where such 18 student or students were not accounted for in the initial apportionment 19 to such school district at the beginning of the school year. 20 § 4. The commissioner of education shall apportion monies for students 21 with disabilities on a quarterly basis, and to allow for the apportion- 22 ment to follow the student from school district to school district 23 throughout the school year. This act shall take effect on the ninetieth day after it shall 2 have become a law. Effective immediately any rules or regulations neces- 3 sary for the timely implementation of the provisions of this act on its 4 effective date may be promulgated on or before such date.
