STATE OF NEW YORK ________________________________________________________________________ 1913 2019-2020 Regular Sessions IN ASSEMBLY January 17, 2019 ___________ Introduced by M. of A. JOYNER -- read once and referred to the Committee on Education AN ACT to amend a chapter of the laws of 2018, relating to authorizing and directing the commissioner of education to conduct a study on the effects of trauma on child development and learning as proposed in legislative bills numbers S.8000-B and A.10063-B, in relation to authorizing and directing the commissioner of children and family services to conduct a study on the effects of trauma on child develop- ment and learning; and to repeal certain provisions of the education law relating thereto The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 59 of section 305 of the education law, as 2 added by a chapter of the laws of 2018, amending the education law 3 relating to authorizing and directing the commissioner of education to 4 conduct a study on the effects of trauma on child development and learn- 5 ing, as proposed in legislative bills numbers S.8000-B and A.10063-B, is 6 REPEALED. 7 § 2. A chapter of the laws of 2018, amending the education law relat- 8 ing to authorizing and directing the commissioner of education to 9 conduct a study on the effects of trauma on child development and learn- 10 ing, as proposed in legislative bills numbers S.8000-B and A.10063-B, is 11 amended by adding a new section 1-a to read as follows: 12 § 1-a. The commissioner of children and family services, in consulta- 13 tion with the commissioner of education and the commissioner of health, 14 is authorized and directed to conduct a study on the effects of trauma 15 on child development and learning. Such study shall include, but not be 16 limited to, the following: 17 (i) the types of trauma experienced by students; 18 (ii) the impacts of trauma on child development and learning; 19 (iii) screening and assessments of trauma available in schools; EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD07037-01-9A. 1913 2 1 (iv) programs, interventions, and services related to trauma that are 2 available in schools; and 3 (v) best practices for school personnel in the area of trauma as it 4 relates to child development and learning. 5 b. On or before December 31, 2020, the commissioner of children and 6 family services shall deliver a report of the findings of such study and 7 recommendations based on such findings to the governor, the temporary 8 president of the senate, the speaker of the assembly, the minority lead- 9 er of the senate and the minority leader of the assembly. Such report 10 shall also include such legislative proposals as the commissioner of 11 children and family services deems necessary to implement his or her 12 recommendations. 13 § 3. This act shall take effect on the same date and in the same 14 manner as a chapter of the laws of 2018, amending the education law 15 relating to authorizing and directing the commissioner of education to 16 conduct a study on the effects of trauma on child development and learn- 17 ing, as proposed in legislative bills numbers S.8000-B and A.10063-B, 18 takes effect.
