THIELE -- read once and referred to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to the period for the taking of striped bass THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Subdivision 4 of section 13-0347 of the environmental 2 conservation law, as added by chapter 990 of the laws of 1983, is 3 amended to read as follows: 4 4. No person shall take or land striped bass in the marine waters of 5 New York state during the period [December 15] JANUARY 1 to April 15 6 inclusive. For purposes of this section "marine waters" means the tidal 7 waters of the state including the Hudson River from the Battery to the 8 George Washington bridge, and "land" shall mean the setting or putting 9 on shore from any boat or vessel or to bring to any port or docking 10 place any striped bass. Possession of striped bass imported into New 11 York other than by boat is not prohibited during the closed season so 12 long as such striped bass are of legal minimum size. Striped bass unin- 13 tentionally taken in violation of this subdivision shall be returned to 14 the water immediately without unnecessary injury. 15 S 2. This act shall take effect immediately.
