       AN ACT to amend the insurance law, in relation to providing coverage for
         vaccinations for travel to foreign countries
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Subsection  (k)  of  section 3221 of the insurance law is
    2  amended by adding a new paragraph 19 to read as follows:
    3    (19) EVERY GROUP OR BLANKET POLICY DELIVERED OR ISSUED FOR DELIVERY IN
    4  THIS STATE WHICH PROVIDES MEDICAL, MAJOR MEDICAL OR  SIMILAR  COMPREHEN-
    5  SIVE-TYPE  COVERAGE MUST PROVIDE COVERAGE FOR VACCINATIONS FOR TRAVEL TO
    6  FOREIGN COUNTRIES THAT  ARE  RECOMMENDED  OR  REQUIRED  BY  THE  FEDERAL
    7  DEPARTMENT  OF HEALTH AND HUMAN SERVICES CENTERS FOR DISEASE CONTROL AND
    8  PREVENTION.
    9    SUCH COVERAGE MAY BE SUBJECT TO ANNUAL DEDUCTIBLES AND COINSURANCES AS
   10  MAY BE DEEMED APPROPRIATE BY THE SUPERINTENDENT AND  AS  ARE  CONSISTENT
   11  WITH THOSE ESTABLISHED FOR OTHER BENEFITS WITHIN A GIVEN POLICY.
   12    S  2.  Section  4303  of  the insurance law is amended by adding a new
   13  subsection (jj) to read as follows:
   14    (JJ) EVERY CONTRACT ISSUED BY A MEDICAL EXPENSE INDEMNITY  CORPORATION
   15  OR  HEALTH  SERVICE CORPORATION WHICH PROVIDES MEDICAL, MAJOR MEDICAL OR
   16  SIMILAR COMPREHENSIVE-TYPE COVERAGE MUST PROVIDE COVERAGE  FOR  VACCINA-
   17  TIONS  FOR  TRAVEL TO FOREIGN COUNTRIES THAT ARE RECOMMENDED OR REQUIRED
   18  BY THE FEDERAL DEPARTMENT OF  HEALTH  AND  HUMAN  SERVICES  CENTERS  FOR
   19  DISEASE CONTROL AND PREVENTION.
   20    SUCH COVERAGE MAY BE SUBJECT TO ANNUAL DEDUCTIBLES AND COINSURANCES AS
   21  MAY  BE  DEEMED  APPROPRIATE BY THE SUPERINTENDENT AND AS ARE CONSISTENT

    1    S 3. This act shall take effect on the first of January next  succeed-
    2  ing  the  date  on  which  it shall have become a law and shall apply to
    3  policies and contracts issued, renewed, modified, altered or amended  on
    4  or after such date.
