        AN ACT to amend the mental  hygiene  law  and  the  racing,  pari-mutuel
          wagering  and  breeding law, in relation to requiring the commissioner
          of addiction services and supports to  establish  a  problem  gambling
          education program

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Section 19.09 of the  mental  hygiene  law  is  amended  by
     2  adding a new subdivision (m) to read as follows:
     3    (m)  The  commissioner, in consultation with the New York state gaming
     4  commission shall establish a problem gambling education  program  to  be
     5  completed  by  all  individuals  that  have  placed themselves on a self
     6  exclusion list pursuant to section one hundred  eleven  of  the  racing,
     7  pari-mutuel  wagering  and  breeding  law  upon  the  expiration  of the
     8  selected exclusion period. This education program shall be  made  avail-
     9  able  on  the  websites of both the office and the New York state gaming
    10  commission and shall include but not be limited to resources  to  treat-
    11  ment.
    12    §  2.  The  opening  paragraph  of  paragraph (a) and paragraph (c) of
    13  subdivision 2 of section 111 of the  racing,  pari-mutuel  wagering  and
    14  breeding  law,  as  amended  by chapter 564 of the   laws   of 2021, are
    15  amended to read as follows:
    16    The commission shall promulgate  rules  and  regulations  pursuant  to
    17  which  people may voluntarily exclude themselves from entering the prem-
    18  ises of an association or corporation licensed or  enfranchised  by  the

     1  commission  pursuant  to  this chapter; receive the required educational
     2  materials pursuant to subdivision (l) of section  19.09  of  the  mental
     3  hygiene law; and, upon the expiration of the selected exclusion  period,
     4  complete the problem gambling education program pursuant to  subdivision
     5  (m)  of  section  19.09  of the mental hygiene law. In promulgating such
     6  rules and regulations the commission shall ensure, to the extent practi-
     7  cable, that there is consistency in  the  process  followed  under  each
     8  division in which an individual may voluntarily exclude themselves. Such
     9  rules and regulations shall provide that:
    10    (c) No voluntary order or request to exclude persons from entering the
    11  premises  of  any  such  association,  corporation,  or  facility may be
    12  rescinded, canceled, or declared null and void until [seven days after a
    13  request] such individual who is self  excluded  completes  in  paper  or
    14  electronic  format, an educational program approved by the office pursu-
    15  ant to the provisions of subdivision (m) of section 19.09 of the  mental
    16  hygiene  law  and  proof of completion has been received by such associ-
    17  ation, corporation, or facility to cancel such order or request.
    18    §  3.  This  act  shall take effect on the sixtieth day after it shall
    19  have become a law.
