GANTT -- read once and referred to the Committee on Education AN ACT validating certain acts done by the Rochester city school district and making them eligible for certain aid THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Legislative intent. The legislature hereby finds that the 2 Rochester city school district approved a capital improvement project 3 which was designated by the state education department as project number 4 0033-015. In addition, the project was eligible for certain state aid. 5 The legislature further finds that due to ministerial error, a required 6 filing for eligibility for such aid was not made by the district in a 7 timely manner making the district ineligible for certain aid. The legis- 8 lature further finds that without such aid, the capital improvement 9 project will impose an additional, unanticipated hardship on district 10 taxpayers. 11 S 2. All the acts done and proceedings heretofore had and taken or 12 caused to be had and taken by the Rochester city school district and by 13 all its officers or agents relating to or in connection with the final 14 building project report to be filed with the state education department 15 for project 0033-015, and all acts incident thereto, are hereby legal- 16 ized, validated, ratified and confirmed, notwithstanding any failure to 17 comply with the approval and filing provisions of the education law or 18 any other law or any other statutory authority, rule or regulation, in 19 relation to any omission, error, defect, irregularity or illegality in 20 such proceedings had and taken provided such report is filed with the 21 state education department no later than July 31, 2009 and provided that 22 any amount due and payable to the Rochester city school district for 23 school years prior to the 2007-2008 school year as a result of this act 24 shall be paid pursuant to the provisions of paragraph c of subdivision 5 25 of section 3604 of the education law. The education department is hereby directed to consider the 2 approved costs of the aforementioned project as valid and proper obli- 3 gations of the Rochester city school district. 4 S 4. This act shall take effect immediately.
