       AN ACT to amend the education law, in relation to the powers and  duties
         of boards of education
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Subdivision 2 of section 2554  of  the  education  law,  as
    2  amended  by  section  2  of part B of chapter 88 of the laws of 2000, is
    3  amended to read as follows:
    4    2. To create, abolish, maintain and consolidate such positions,  divi-
    5  sions,  boards  or bureaus as, in its judgment, may be necessary for the
    6  proper and efficient administration of its work;  to  appoint  a  super-
    7  intendent  of  schools,  such  associate,  assistant, district and other
    8  superintendents, examiners, directors, supervisors,  principals,  teach-
    9  ers,  lecturers,  special instructors, medical inspectors, nurses, audi-
   10  tors, attendance officers, secretaries, clerks, custodians, janitors and
   11  other employees and other persons or experts in educational,  social  or
   12  recreational  work  or  in  the  business management or direction of its
   13  affairs as said  board  shall  determine  necessary  for  the  efficient
   14  management  of  the  schools and other educational, social, recreational
   15  and business activities; provided, however,  that  in  the  city  school
   16  districts  of the cities of Buffalo and Rochester appointment of associ-
   17  ate, assistant and district superintendents, and other supervising staff
   18  who are excluded from the right  to  bargain  collectively  pursuant  to
   19  article  fourteen  of  the  civil  service law shall, within the amounts
   20  budgeted for such positions, be  by  the  superintendent  of  such  city
   21  school  district;  and  to  determine  their  duties except as otherwise
   22  provided herein. NO PERSON WHO HAS SERVED AS A MEMBER OF  THE  BOARD  OF
   23  EDUCATION  IN THE CITY SCHOOL DISTRICT OF THE CITY OF ROCHESTER SHALL BE
   24  EMPLOYED BY SUCH CITY SCHOOL DISTRICT WITHIN THE TWO YEARS FOLLOWING THE
   25  TERMINATION OR CONCLUSION OF SUCH SERVICE.
   26    S 2. This act shall take effect immediately and  shall  apply  to  all
   27  candidates  for  employment  by  the city school district of the city of
   28  Rochester on or after such effective date.
