LOPEZ, MAGEE, MAISEL, MOLI- NARO -- read once and referred to the Committee on Corporations, Authorities and Commissions AN ACT to create a temporary state commission to provide for the dissol- ution of the New York state thruway authority and the reassignment of the powers, obligations and duties thereof; abolishes the New York state thruway authority; and providing for the repeal of certain provisions upon expiration thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. A temporary state commission on the dissolution of the New 2 York state thruway authority, hereinafter referred to as the commission, 3 is hereby created to develop and propose legislation to implement the 4 abolishment of the New York state thruway authority and recommending the 5 appropriate state and local agencies or offices to assume the various 6 responsibilities and obligations of such authority. 7 S 2. The commission shall consist of fifteen members to be appointed 8 as follows: seven members to be appointed by the governor; three members 9 to be appointed by the temporary president of the senate; three members 10 to be appointed by the speaker of the assembly; one member to be 11 appointed by the minority leader of the senate; and one to be appointed 12 by the minority leader of the assembly. A chair of the commission shall 13 be appointed by the governor from among his appointees. Vacancies shall 14 be filled in the same manner as the original appointments. 15 S 3. The members of the commission shall receive no compensation for 16 their services, but shall be allowed their actual and necessary expenses 17 incurred in the performance of their duties hereunder. 18 S 4. To the maximum extent feasible, the commission shall be entitled 19 to request and receive and shall utilize and be provided with such 20 facilities, resources, and data of any department, division, board, EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD06780-01-1 A. 2671 2 1 bureau, commission, or agency of the state or any political subdivision 2 thereof as it deems necessary or desirable to carry out properly its 3 powers and duties hereunder. 4 S 5. Once the commission has been established, the chairman of the New 5 York state thruway authority shall submit a letter to such commission 6 justifying the existence of such authority. 7 S 6. The commission shall submit its findings and recommendations for 8 legislation and transfer of the powers, obligations and duties of the 9 New York state thruway authority in a report to the governor, the tempo- 10 rary president of the senate, and the speaker of the assembly not later 11 than April 1, 2012. 12 S 7. The New York state thruway authority, as constituted by title 9 13 of article 2 of the public authorities law is hereby abolished and the 14 powers, functions, obligations and duties of such entity shall be trans- 15 ferred, assumed or eliminated pursuant to the recommendations set forth 16 in the report of the commission submitted in accordance with section six 17 of this act. 18 S 8. This act shall take effect immediately; provided that the members 19 of the commission created by this act shall be appointed within thirty 20 days of such effective date; and provided, further, that sections one 21 through six of this act shall remain in effect until one hundred twenty 22 days after the commission submits the report required by section six of 23 this act, at which time sections one through six of this act shall 24 expire and be deemed repealed; and provided, further that section seven 25 of this act shall take effect December 31, 2012 and the amendment, 26 enactment or repeal of any laws, rules or regulations necessary to 27 effectuate the provisions of such section seven are authorized to be 28 made before such date.
