       AN ACT to amend the state finance law, in relation to expanding entities
         that may purchase recycled or remanufactured commodities
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Subdivision 6 of section 163 of the state finance law, as
    2  amended by chapter 173 of the laws  of  2010,  is  amended  to  read  as
    3  follows:
    4    6. Discretionary buying thresholds. Pursuant to guidelines established
    5  by the state procurement council: the commissioner may purchase services
    6  and  commodities in an amount not exceeding eighty-five thousand dollars
    7  without a  formal  competitive  process;  state  agencies  may  purchase
    8  services  and  commodities  in  an  amount  not exceeding fifty thousand
    9  dollars without a formal competitive process;  and  state  agencies  may
   10  purchase  commodities  or services from small business concerns or those
   11  certified pursuant to article fifteen-A of the executive law, or commod-
   12  ities or technology that are recycled or remanufactured,  in  an  amount
   13  not  exceeding two hundred thousand dollars without a formal competitive
   14  process; AND A COUNTY, CITY, TOWN, VILLAGE, SCHOOL DISTRICT OR A  PUBLIC
   15  BENEFIT CORPORATION PERFORMING OR FINANCING SERVICES INTENDED TO BENEFIT
   16  THE  HEALTH  OF  CITIZENS  MAY PURCHASE COMMODITIES THAT ARE RECYCLED OR
   17  REMANUFACTURED, IN AN AMOUNT NOT EXCEEDING FIFTY THOUSAND DOLLARS  WITH-
   18  OUT A FORMAL COMPETITIVE PROCESS.
   19    S  2.  This  act shall take effect on the ninetieth day after it shall
   20  have become a law, provided, however  that  any  rules  and  regulations
   21  necessary  for  the  timely  implementation of this act on its effective
   22  date shall be promulgated on or before such date; provided, further that
   23  the amendments to section 163 of the state finance law made  by  section
   24  one of this act shall not affect the repeal of such section and shall be
   25  deemed repealed therewith.
