ORTIZ, LIFTON -- read once and referred to the Committee on Health AN ACT to authorize the commissioner of health to develop a plan for voluntary reduction or elimination in the use of trans fat in various food service providers THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Voluntary trans fat reduction or elimination program. 1. 2 The commissioner of health is hereby authorized to develop a voluntary 3 trans fat reduction or elimination program. For purposes of this 4 section, "trans fat" means a specific type of fat formed when liquid 5 fats are made into solid fats by the addition of hydrogen atoms, in a 6 process known as hydrogenation. Such program shall consist of two main 7 components: a public information campaign and a protocol for voluntarily 8 reducing or eliminating the use of trans fats in foods prepared by: 9 a. food service establishments, including: restaurants, bars, member- 10 ship organizations, fraternal organizations, and private clubs, except- 11 ing establishments licensed pursuant to section 64-a of the alcoholic 12 beverage control law, that are not regulated by the department of agri- 13 culture and markets; and 14 b. any institution under the jurisdiction of the department of health 15 including, but not limited to: public schools, hospitals, nursing homes, 16 and adult and child daycare facilities. 17 2. The public information campaign shall be developed, in consultation 18 with the department of education, to provide public service announce- 19 ments, website sources and educational brochures about the health risks 20 associated with trans fat in foods. 21 3. The commissioner of health, in consultation with the commissioner 22 of education, shall include in the department of health's annual report 23 not later than December 31, 2014, a report assessing the success of the 24 voluntary trans fat reduction or elimination program. LBD06728-01-3 A. 3108 2 1 contain an evaluation of the effectiveness of the voluntary reduction or 2 elimination program in reducing or eliminating the use of trans fat in 3 prepared foods sold or provided in New York state, and any recommenda- 4 tions relating thereto. Such report shall be submitted to the governor, 5 the temporary president of the senate, the speaker of the assembly, and 6 any appropriate committees of the legislature concerned with nutritional 7 standards and health in New York state. 8 S 2. This act shall take effect immediately. The commissioner of 9 health is authorized and directed to promulgate any and all rules and 10 regulations and take any other measures necessary to implement this act 11 on its effective date on or before such date.
