ERRIGO -- read once and referred to the Committee on Tourism, Arts and Sports Development AN ACT to amend the canal law and the public authorities law, in relation to local waterfront revitalization plans and programs THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Paragraphs a and c of subdivision 1 of section 138-a of the 2 canal law, as amended by chapter 243 of the laws of 1993, are amended to 3 read as follows: 4 a. the chairman of the authority, the commissioner of transportation, 5 the commissioner of the office of parks, recreation and historic preser- 6 vation [and], the commissioner of environmental conservation AND THE 7 SECRETARY OF STATE, or their representatives; 8 c. the commissioner of economic development [and the secretary of 9 state,] or [their representatives] HIS OR HER REPRESENTATIVE, and a 10 member from each of the regional planning boards, as established by 11 articles five-G and twelve-B of the general municipal law, whose region 12 is intersected by the canal shall be ex-officio, non-voting members of 13 the commission and shall provide technical expertise and advice to the 14 commission as necessary. 15 S 2. Subdivision 4 of section 138-b of the canal law, as amended by 16 chapter 335 of the laws of 2001, is amended and a new subdivision 8 is 17 added to read as follows: 18 4. If deemed appropriate, request that studies, surveys or analyses be 19 performed by the corporation, the departments of transportation, econom- 20 ic development [and], environmental conservation, STATE and/or the EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD04794-01-9 S. 1173 2 A. 3330 1 office of parks, recreation and historic preservation to assist in the 2 development, promotion, marketing and/or preservation of the canal 3 system or the preparation of the plan. At the request of the commission, 4 state agencies and public authorities shall cooperate fully and shall 5 provide requested information in a timely manner. 6 8. ENCOURAGE LOCAL GOVERNMENTS TO PREPARE LOCAL WATERFRONT REVITALIZA- 7 TION PROGRAMS AND PLANS PURSUANT TO ARTICLE FORTY-TWO OF THE EXECUTIVE 8 LAW FOR THE PURPOSE OF REFINING THE STATEWIDE CANAL RECREATIONWAY PLAN. 9 SUCH ENCOURAGEMENT MAY INCLUDE THE PROVISION OF FINANCIAL ASSISTANCE TO 10 PREPARE AND IMPLEMENT SUCH PLANS AND PROGRAMS. 11 S 3. Subdivision 1 of section 384 of the public authorities law is 12 amended by adding a new paragraph (c) to read as follows: 13 (C) THE AUTHORITY IS HEREBY AUTHORIZED TO PROVIDE FINANCIAL ASSISTANCE 14 TO MUNICIPALITIES FOR THE PURPOSE OF UNDERTAKING THE PREPARATION AND 15 IMPLEMENTATION OF LOCAL WATERFRONT REVITALIZATION PLANS AND PROGRAMS. 16 S 4. This act shall take effect immediately.
