       AN ACT to amend the education law, in relation to directing the  commis-
         sioner  of  education  to  establish standards for the maintenance and
         repair of school buildings and exempting expenditures for the  mainte-
         nance and repair of school buildings from the tax levy limit
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 305 of the education law is amended by adding a new
    2  subdivision 53 to read as follows:
    3    53. THE COMMISSIONER SHALL, BY RULE, ESTABLISH MINIMUM  STANDARDS  FOR
    4  THE  MAINTENANCE  AND  REPAIR  OF  SCHOOL  BUILDINGS SO AS TO PROVIDE AN
    5  APPROPRIATE LEARNING ENVIRONMENT WITHIN EACH SUCH BUILDING.
    6    S 2. Subparagraphs (iii) and (iv) of paragraph i of subdivision  2  of
    7  section  2023-a of the education law, as added by section 2 of part A of
    8  chapter 97 of the laws of 2011, are amended and a new  subparagraph  (v)
    9  is added to read as follows:
   10    (iii)  in  years in which the normal contribution rate of the New York
   11  state teachers' retirement system, as defined by paragraph a of subdivi-
   12  sion two of section five hundred seventeen of this chapter, increases by
   13  more than two percentage points from  the  previous  year,  a  tax  levy
   14  necessary  for  expenditures  for  the  coming  fiscal  year  for school
   15  district employer contributions to the New York state teachers'  retire-
   16  ment  system  caused by growth in the normal contribution rate minus two
   17  percentage points; [and]
   18    (iv) a capital tax levy[.]; AND
   19    (V) A TAX LEVY NECESSARY FOR  EXPENDITURES  FOR  THE  MAINTENANCE  AND
   20  REPAIR OF SCHOOL BUILDINGS.

    1    S  3.  This act shall take effect on the first of July next succeeding
    2  the date on which it shall have become a law, provided  that,  effective
    3  immediately,  any  rules  and  regulations  necessary  to  implement the
    4  provisions of this act on its effective date are authorized and directed
    5  to  be  promulgated, amended and/or repealed on or before such date; and
    6  provided further that the amendments to section 2023-a of the  education
    7  law  made by section two of this act shall not affect the repeal of such
    8  section and shall be deemed repealed therewith.
