        AN ACT to amend the state  technology law, in relation to creating   the
          resultsNY.gov website
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. Legislative findings and declaration. The legislature here-
     2  by finds and declares  that  many  New  York  state  agencies  currently
     3  provide  valuable  information to the public regarding policy issues and
     4  government programs and initiatives. However, the public  would  clearly
     5  benefit  by having website access to important performance-based statis-
     6  tics, policy issues and comparative information on a user-friendly  "one
     7  stop  shopping"  basis.  Such a website would dramatically expand public
     8  access to useful information and enable taxpayers to more readily review
     9  and better understand the many state programs that affect the quality of
    10  life such as public safety, education, energy, transportation,  housing,
    11  health,  law  enforcement  and the environment.   Additionally, it would
    12  enhance government transparency  and  accountability  while  helping  to
    13  ensure the public that their taxes are being spent prudently.
    14    Therefore,  to achieve the above-stated intent, the legislature hereby
    15  finds and declares that there be established the "resultsNY.gov" website
    16  to be initiated, operated and maintained by the state office  for  tech-
    17  nology  with  oversight  authority  by  the  committee on resultsNY.gov.
    18  Patterned after the federal office of management  and  budget's  Expect-
    19  More.gov  website,  this  proposal  will  establish a new, user-friendly
    20  website that provides the public with the ability to review the perform-
    21  ance of state government  agencies  and  programs.  ResultsNY.gov  would
    22  provide  a  new  single access website, with specific indicators to help
    23  the public determine how effectively tax dollars are  being  spent,  and
    24  how individual government programs are performing.

     1    §  2.  Section  103 of the state technology law is amended by adding a
     2  new subdivision 22 to read as follows:
     3    22.  To  request  and  receive  from  any department, division, board,
     4  commission or other agency of the state, any information  and  resources
     5  necessary  to carry out the responsibilities and provisions set forth in
     6  article four of this chapter.
     7    § 3. Subdivisions 3 and 4 of section 105 of the state technology  law,
     8  as  added  by chapter 430 of the laws of 1997 and such section as renum-
     9  bered by chapter 437 of the  laws  of  2004,  are  amended  to  read  as
    10  follows:
    11    3. To recommend surveys and reports to be completed by the director to
    12  carry out all of the objectives and purposes of this article; [and]
    13    4.  To  provide  guidance and support to the office in the development
    14  and improvements to the format and content of resultsNY.gov; and
    15    5. To perform such other acts as may be assigned by the chairperson of
    16  the council which are necessary or appropriate to carry  out  the  func-
    17  tions of the council.
    18    §  4. The state technology law is amended by adding a new article 4 to
    19  read as follows:

    22  Section 401. Short title.
    23          402. Definitions.
    24          403. ResultsNY.gov.
    25    § 401. Short title. This article shall be known and may  be  cited  as
    26  the "resultsNY.gov act".
    27    § 402. Definitions. For the purposes of this article:
    28    1.  "Electronic"  shall mean of or relating to technology having elec-
    29  trical, digital, magnetic, wireless, optical, electromagnetic, or  simi-
    30  lar capabilities.
    31    2.  "Electronic  record"  shall  mean information, evidencing any act,
    32  transaction, occurrence, event, or other activity, produced or stored by
    33  electronic means and capable of being  accurately  reproduced  in  forms
    34  perceptible by human sensory capabilities.
    35    3.  "Governmental  entity"  shall  mean  any  state department, board,
    36  bureau, division, commission, committee, public authority, public  bene-
    37  fit  corporation, council, office, or other governmental entity or offi-
    38  cer of the state having statewide authority, except the  state  legisla-
    39  ture, and any political subdivision of the state.
    40    §  403.  ResultsNY.gov. 1. The office, in cooperation and consultation
    41  with the council, shall establish,  maintain,  update  and  operate  the
    42  resultsNY.gov  website.  The  office  may  request from any governmental
    43  entity such cooperation in furnishing it  with  information  that  shall
    44  enable  the office to carry out its duties pursuant to this section. All
    45  governmental entities are authorized and  directed  to  provide  to  the
    46  office  such  cooperation,  assistance,  service,  advice and electronic
    47  records in a timely manner.
    48    2. The office shall ensure the resultsNY.gov website shall provide  to
    49  the  user of the website comparative data and statistics to identify the
    50  state's performance regionally  and  nationally  relating  to,  but  not
    51  limited  to, the economy, education, public safety, energy, housing, and
    52  the environment.
    53    3. The office, in cooperation and consultation with the council, shall
    54  collect from any and all  governmental  entities  government  management
    55  accountability  and  performance  data.  Such  data, at a minimum, shall
    56  determine:

     1    (a) does the program address a specific and existing problem, interest
     2  or need;
     3    (b) is the program designed so that it is not redundant or duplicative
     4  of any other federal, state, local or private effort;
     5    (c)  does  the  program  have  a  limited number of specific long-term
     6  performance measures that focus on outcomes and meaningfully reflect the
     7  purpose of the program;
     8    (d) does the program have ambitious targets  and  timeframes  for  its
     9  long-term measures;
    10    (e)  does  the program, including program partners, achieve its annual
    11  performance goals;
    12    (f) are  independent  evaluations  of  sufficient  scope  and  quality
    13  conducted  on  a  regular basis or as needed to support program improve-
    14  ments and evaluate effectiveness and relevance to the problem, interest,
    15  or need;
    16    (g) are budget requests explicitly tied to accomplishment of the annu-
    17  al and long-term performance goals, and are the resource needs presented
    18  in a complete and transparent manner in the program's budget;
    19    (h) does the program use strong financial management practices;
    20    (i) has the program demonstrated adequate progress  in  achieving  its
    21  long-term performance goals; and
    22    (j)  does the program demonstrate improved efficiencies or cost effec-
    23  tiveness in achieving program goals each year.
    24    4. The office shall ensure  the  resultsNY.gov  website  shall  enable
    25  members  of  the public to submit suggestions and recommendations on how
    26  to save taxpayer money, help eliminate wasteful  spending,  and  operate
    27  government more efficiently and cost effectively. Such suggestions shall
    28  be reviewed by the office and displayed on the website.
    29    § 5. This act shall take effect on the one hundred twentieth day after
    30  it  shall have become a law. Effective immediately, the addition, amend-
    31  ment and/or repeal of any rule or regulation necessary for the implemen-
    32  tation of this act on its effective date are authorized and directed  to
    33  be made and completed on or before such effective date.
