STATE OF NEW YORK ________________________________________________________________________ 3429 2017-2018 Regular Sessions IN ASSEMBLY January 27, 2017 ___________ Introduced by M. of A. McKEVITT, GRAF -- read once and referred to the Committee on Health AN ACT to amend the public health law, in relation to establishing a state-wide database on the location and availability of medical proce- dures The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraphs (b) and (c) of subdivision 1 of section 2995-b 2 of the public health law, as added by chapter 542 of the laws of 2000, 3 are amended and a new paragraph (d) is added to read as follows: 4 (b) Statewide performance data comparing utilization and selected 5 performance measures to accepted norms and/or benchmarks developed by 6 recognized experts, which were developed pursuant to subparagraph (iii) 7 of paragraph (a) of subdivision one of the former section twenty-eight 8 hundred seven-n of this chapter, as added by section sixty of chapter 9 six hundred thirty-nine of the laws of nineteen hundred ninety-six; 10 [and] 11 (c) Other hospital data, if any, collected for public dissemination by 12 the state task force on health care quality improvement pursuant to the 13 former section twenty-eight hundred four-b of this chapter, as added by 14 section sixty-a of chapter six hundred thirty-nine of the laws of nine- 15 teen hundred ninety-six[.]; and 16 (d) Establish a state-wide database of all medical procedures 17 performed in hospitals in the state. The database shall list each 18 medical procedure and provide information on which hospitals are 19 equipped to perform such medical procedure. 20 § 2. Section 2995-b of the public health law is amended by adding two 21 new subdivisions 4 and 5 to read as follows: 22 4. Electronic access. The department shall promulgate any rules 4 and regulations necessary for the implementation of such database estab- 5 lished pursuant to paragraph (d) of subdivision one of this section. 6 § 3. This act shall take effect immediately.
