STATE OF NEW YORK ________________________________________________________________________ 3625 2021-2022 Regular Sessions IN ASSEMBLY January 28, 2021 ___________ Introduced by M. of A. CYMBROWITZ -- read once and referred to the Committee on Cities AN ACT to amend the New York city charter, in relation to land use review for conformity with bulk regulations The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The New York city charter is amended by adding a new 2 section 197-e to read as follows: 3 § 197-e. Land use review for conformity with bulk regulations. The 4 commissioner of the department of buildings shall establish a program 5 whereby professional engineers and registered architects licensed to 6 practice engineering or architecture under section seventy-two hundred 7 two or seventy-three hundred two of the education law shall submit 8 applications solely respecting the building bulk of all proposals for 9 changes, approvals, contracts, consents, permits or authorization there- 10 of respecting the use, development or improvement of real property 11 subject to city regulation to the department of buildings for review and 12 comment. The department of buildings shall determine whether such appli- 13 cations comply with the bulk regulations found in article three of the 14 zoning resolution. 15 Notwithstanding any other law, rule or regulation to the contrary, 16 applications solely respecting bulk review shall not be approved pursu- 17 ant to professional certification. 18 § 2. This act shall take effect on the ninetieth day after it shall 19 have become a law. Effective immediately, the addition, amendment 20 and/or repeal of any rule or regulation necessary for the implementation 21 of this act on its effective date are authorized to be made and 22 completed on or before such effective date.
