        AN ACT to amend the vehicle and traffic law, in relation  to  suspending
          the registration of vehicles which have been documented multiple times
          by a photo speed violation monitoring system for speeding in a highway
          construction or maintenance work area

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subdivision (e) of section 1180-e of the vehicle and  traf-
     2  fic law, as added by chapter 421 of the laws of 2021, is amended to read
     3  as follows:
     4    (e) 1. An owner liable for a violation of subdivision (b), (d), (f) or
     5  (g)  of  section  eleven  hundred  eighty  of this article pursuant to a
     6  demonstration program established pursuant  to  this  section  shall  be
     7  liable  for  monetary  penalties not to exceed fifty dollars for a first
     8  violation, seventy-five dollars for a second  violation  both  of  which
     9  were  committed  within  a  period  of  eighteen months, and one hundred
    10  dollars for a third or subsequent violation all of which were  committed
    11  within  a  period  of  eighteen months; provided, however, that an addi-
    12  tional penalty not in excess of twenty-five dollars for  each  violation
    13  may be imposed for the failure to respond to a notice of liability with-
    14  in the prescribed time period.
    15    2. (i) The registration of a vehicle which has been documented four or
    16  more  times  within an eighteen-month period for a violation of subdivi-
    17  sion (b), (d), (f) or (g) of section eleven hundred eighty of this arti-
    18  cle pursuant to a demonstration program  established  pursuant  to  this
    19  section  shall  be  suspended  for  a  period  of  ninety  days for each
    20  violation beyond the third that occurs within such eighteen-month  peri-
    21  od.  Such  period of suspension shall commence ten days after the notice
    22  of liability for the fourth or subsequent violation has been mailed.

     1    (ii) This paragraph shall not apply to a rental vehicle, as defined in
     2  section one hundred thirty-seven-a of this chapter.
     3    §  2.  This  act shall take effect immediately; provided, however, the
     4  amendments to subdivision (e) of section 1180-e of the vehicle and traf-
     5  fic law made by section one of this act shall not affect the  repeal  of
     6  such section and shall be deemed repealed therewith.
