STATE OF NEW YORK ________________________________________________________________________ 4080 2019-2020 Regular Sessions IN ASSEMBLY February 1, 2019 ___________ Introduced by M. of A. ZEBROWSKI -- read once and referred to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to authorizing the issuance of "Support Recovery" license plates; to amend the state finance law, in relation to authorizing the deposit of certain moneys into the opioid stewardship fund; and providing for the repeal of certain provisions upon expiration thereof The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The vehicle and traffic law is amended by adding a new 2 section 404-ff to read as follows: 3 § 404-ff. Distinctive "Support Recovery" license plates. 1. Any person 4 residing in this state shall, upon request, be issued a distinctive 5 license plate of a design developed and approved by the commissioner. 6 Application for said license plate shall be filed with the commissioner 7 in such form and detail as the commissioner shall prescribe. 8 2. A distinctive "Support Recovery" license plate issued pursuant to 9 this section shall be issued in the same manner as other number plates 10 upon the payment of the regular registration fee prescribed by section 11 four hundred one of this article; provided, however, that an additional 12 annual service charge of twenty-five dollars shall be charged for such 13 plate. 14 3. Each twenty-five dollars received as the additional service charge 15 under this section shall be deposited to the credit of the "opioid 16 stewardship fund" established pursuant to section ninety-seven-aaaaa of 17 the state finance law and shall be used to support programs undertaken 18 pursuant to section ninety-seven-aaaaa of the state finance law. 19 § 2. Subdivision 3 of section 97-aaaaa of the state finance law, as 20 added by section 3 of part NN of chapter 57 of the laws of 2018, is 21 amended to read as follows: EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. The opioid stewardship fund shall consist of all moneys collected 2 pursuant to section four hundred four-ff of the vehicle and traffic law, 3 of moneys appropriated for the purpose of such account, moneys trans- 4 ferred to such account pursuant to law, contributions consisting of 5 promises or grants of any money or property of any kind or value, or any 6 other thing of value, including grants or other financial assistance 7 from any agency of government and moneys required by the provisions of 8 this section or any other law to be paid into or credited to this 9 account. 10 § 3. 1. A distinctive plate established pursuant to section 404-ff of 11 the vehicle and traffic law, as added by section one of this act, shall 12 only be designated, produced, and issued upon delivery to the department 13 of motor vehicles of a surety bond in the amount of six thousand 14 dollars, which shall be executed by a surety company authorized by the 15 department of financial services to transact business in this state. 16 Provided, however, that if the commissioner of motor vehicles shall have 17 received prior to plate design, production, and issuance at least two 18 hundred orders for such distinctive plate together with the additional 19 annual service charge applicable to each such order, which shall be 20 non-refundable, no such surety bond shall be required. All service 21 charges collected pursuant to this section shall be deposited pursuant 22 to the provisions of section 404-oo of the vehicle and traffic law to 23 the credit of the department of motor vehicles distinctive plate devel- 24 opment fund established by section 95-g of the state finance law and 25 shall be used for the design, production, advertising, and distribution 26 of distinctive license plates in accordance with such section 95-g. 27 2. If, upon, the expiration of two years following the date upon which 28 distinctive plates in the series are first available for sale two 29 hundred or more sets of such plates are sold, a bond delivered pursuant 30 to this section shall be discontinued. If fewer than two hundred sets of 31 such plates are sold by such time, the department of motor vehicles 32 shall be entitled to recover against the bond in an amount proportionate 33 to such shortfall. 34 § 4. This act shall take effect immediately; provided, however, that 35 section one of this act shall take effect on the one hundred eightieth 36 day after it shall have become law provided, further that sections one 37 and three of this act shall expire and be deemed repealed on the same 38 date as section 97-aaaaa of the state finance law repeals pursuant to 39 section 5 of part NN of chapter 57 of the laws of 2018; provided, 40 further that the amendments made to section 97-aaaaa of the state 41 finance law by section two of this act shall not affect the repeal of 42 such section and shall be deemed repealed therewith. Effective imme- 43 diately, the addition, amendment, and/or repeal of any rule or regu- 44 lation necessary for the implementation of this act on its effective 45 date are authorized and directed to be made and completed on or before 46 such effective date.
