       AN ACT to amend the public health law,  in  relation  to  directing  the
         department of health to contract with community-based and not-for-pro-
         fit  organizations  for  the  provision  of information on health care
         services and benefits available to immigrants
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Paragraphs (u) and (v) of subdivision 1 of section 201 of
    2  the public health law, paragraph (u) as added by chapter 939 of the laws
    3  of 1976 and paragraph (v) as added by chapter 474 of the laws  of  1996,
    4  are amended and a new paragraph (w) is added to read as follows:
    5    (u)    engage  in  research  into the causes of rocky mountain spotted
    6  fever and the prevention thereof and develop programs for the control of
    7  ticks, insects and [anthropods]  ARTHROPODS  which  act  as  vectors  of
    8  disease affecting man, within funds made available for such purposes[.];
    9    (v) act as the single state agency for medical assistance, pursuant to
   10  section  three  hundred  sixty-three-a  of  the social services law, [as
   11  amended by this chapter,] with responsibility to supervise the plan  for
   12  medical  assistance as required by title XIX of the federal Social Secu-
   13  rity act, or its successor, and to adopt regulations as may be necessary
   14  to implement this plan[.]; AND
   15    (W)(I) WITHIN AMOUNTS APPROPRIATED THEREFOR, CONTRACT WITH  COMMUNITY-
   16  BASED ORGANIZATIONS AND NOT-FOR-PROFIT CORPORATIONS FOR THE PROVISION OF
   17  OUTREACH,  INFORMATION  AND EDUCATIONAL SERVICES TO NATURALIZED CITIZENS
   18  AND ALIENS ON HEALTH CARE SERVICES AND BENEFITS WHICH ARE  AVAILABLE  TO
   19  SUCH PERSONS. SUCH OUTREACH, INFORMATION AND EDUCATIONAL SERVICES SHALL:
   20    (A) DESIGNATE WHICH HEALTH CARE SERVICES ARE AVAILABLE TO SUCH PERSONS
   21  IN THE COMMUNITY IN WHICH THEY RESIDE;

    1    (B) INCLUDE THE ELIGIBILITY REQUIREMENTS FOR THE FOLLOWING PROGRAMS:
    2    (1)  MEDICAL  ASSISTANCE AND EMERGENCY MEDICAL ASSISTANCE, PURSUANT TO
    3  TITLE ELEVEN OF ARTICLE FIVE OF THE SOCIAL SERVICES LAW,
    4    (2) FAMILY HEALTH PLUS, PURSUANT TO TITLE ELEVEN-D OF ARTICLE FIVE  OF
    5  THE SOCIAL SERVICES LAW,
    6    (3)  CHILD  HEALTH  INSURANCE PLAN, PURSUANT TO TITLE ONE-A OF ARTICLE
    7  TWENTY-FIVE OF THIS CHAPTER, AND
    8    (4) ANY OTHER HEALTH BENEFIT PROGRAM THE COMMISSIONER DEEMS  APPROPRI-
    9  ATE;
   10    (C)  PROVIDE  INFORMATION  ON  THE  MANNER  IN WHICH TO APPLY FOR SUCH
   11  PROGRAMS; AND
   12    (D) BE PROVIDED IN A MANNER AND THE LANGUAGE WHICH IS MOST APPROPRIATE
   13  FOR THE COMMUNITY TO WHICH THE  OUTREACH,  INFORMATION  AND  EDUCATIONAL
   14  SERVICES ARE TO BE PROVIDED.
   15    (II)  THE DEPARTMENT SHALL PROMULGATE ANY RULES AND REGULATIONS NECES-
   16  SARY TO IMPLEMENT THE PROVISIONS OF THIS  PARAGRAPH.  IN  ADDITION,  THE
   17  DEPARTMENT  SHALL  PROVIDE ALL EDUCATIONAL MATERIALS NECESSARY TO IMPLE-
   18  MENT THE PROVISIONS OF  THIS  PARAGRAPH  AND  SHALL  PAY  THE  COSTS  OF
   19  DISTRIBUTING SUCH MATERIALS.
   20    S 2. This act shall take effect on the one hundred eightieth day after
   21  it  shall  have become a law; provided, however, that any actions neces-
   22  sary for the implementation of the provisions of this act on its  effec-
   23  tive  date  are  authorized  and  directed to be taken on or before such
   24  date.
